Dear Experts,
One of my friend Mr. A has entered into an agreement with Mr. B to purchase a assigned land in Hyderabad and paid advance.To resell the land the sub-registar has refused for the reason it is a assigned land and for want of NOC from the Govt.Due to lack of funds to obtain NOC he requested to Mr.C, D, E ( Friends) to invest and after disposing he is ready to pay profit share.Mr. C,D,E approached senior advocate and filed case as Mr. A is a petitoner,Mr. B , Conerned MRO, Sub Registar as a respondents.The Honb. High court has given Orders to the sub-registar not to object for registration. The favorable orders are in favor of Mr. A, Mr.B (Actual Owner of the Land) is ready to register the land.
Now the question is, as per the commitment of Mr. A to Mr.C,D,E, wants to enter into agreement for the amount invested to obtain court orders,If Mr. C D E is included in the sale agreement made by Mr. A with Mr. B is it safe OR shall Mr.C,D,E should enter into a saperate agreement with Mr. A ( Like Partner Ship), the court order is in favor of Mr. A.Please guide me.
