Extortion menance of builders

BULDER SOLD FLAT@2600 TO 3000/SQft for 2150 sq.ft of SUPERBUILT AREA,with possession of 1695 sq.ft built up area.The ownership rights of superbuiltup - built up area was kept with vendor and builder. Is this not a open fraud??? .what is posion of law of land in this case in rajasthan.

what does the agreement mention . at least in maharashtra sale has to be by carpet area .

generally practice is builder unoffically sell by super builyt up area . at time of sale you have to be vigilant and ask what is carpet area of flat .

if sale has been done contrary to ahreement move consumer forum for deficency in service for compensation

In standard circumstance in WB the built up area is lesser than 25% from the super built up area.
Do take information about the your proportionate contribution ot the common areas.
If you have prima fcaie proof of fraud then do file complaint in the Consumer Forum.
