Question about legal heirs

I had posted this question earlier and there was a response but I am not able to post a follow up to that query hence reposting :
Under the Hindu Succession Act for Males, Brothers and Sisters come under Class II Second Entry. Are only surviving brothers and sisters covered under this or are legal heirs of deceased brothers and sisters also entitled to a share? Thanks.

By virtue of provisions of Section 9, heirs of deceased brothers and sisters are not entitled to inherit if there are surviving brothers and sisters.

You ought to have mentioned the full facts.If there is no legal heirs,the property will devolve on secondline heirs ie. brothers and sisters for which the succession certificate from the court to be produced.

Yes, there are no Class I heirs hence Class II heirs apply in this case. Thanks.

The class II legal heirs surviving he deceased will be entitled and not the legal heirs of the deceased brothers and sisters while the survivors are themselves such heirs.
