Agreement of sale

(Querist) 03 December 2014 This query is : Resolved
i am selling a commercial property to the tenant . he is asking a time of 1 year for the payment . what clause should be added in the agreement so that he should not sell the same property to 3rd party .. please suggest
ajay sethi (Expert) 03 December 2014
1 YEAR is too long period to make full payment . better ask purchaser to arrange funds and then enter into agreement wherein you get full payment at time of execution of sale deed . inform seller you wont premises to any other party in meantime .
WASEEM (Querist) 03 December 2014
SIR I AM THE OWNER OF THAT PROPERTY . AND THE PURCHASER WHO IS THE TENANT IS WILLING TO PAY THE RENT TILL THE REGISTRATION .

SO WHAT CLAUSE CAN BE ADDED IN WHICH SHOULD NOT SELL THE PROPERTY TILL THE REGISTRATION OR THE INVOLVEMENT OF 3RD PARTY

your lawyer will do the needful .

Dear Waseem,
When he is paying you the rent, what is the urgency in entering into a sale agreement? If he is going to pay the consideration after one year, you can as well execute the sale deed after one year.
I do not understand why you want to hurry the matter.
Advocate. Arunagiri (Expert) 05 December 2014
You can include the clause for making the payment in installments. You can mention the period on which date the installments should be paid.

Take the help of the advocate for drafting.
