Landlord increasing house rent in every year

I am staying in New Delhi. Our landlord is increasing house rent in every year. We staying at this house since May 2010. That time house rent was 7300/-. Now the rent amount we are paying Rs. 9500/-. He never give us REnt Agreement. When we asked for that, he denied. Even he is list bothered if there is any issue (regarding maintenance) at that house. We are paying the rent in cash as he is not ready to accept Bank cheque. There is no paint done at this house though he promised to do the same after 3 yrs. Now again he is asking to increase the rent. Even he is disagree to pay the repairing charge of the electric pump cost Rs. 3500/-. What should we do?

Is there any rent agreement in this respect?

If you are not satisfied with the position, you can change the house.

In absence of any agreement you may not be able to prove terms of rent agreement and may loose relief from law.

Mr. Rajeev, no rent agreement given by the landlord till date, though we asked for the same many times. So there is no proof so that he may increase rent in every 11 months instead of every 3 yrs. But Electricity bill is paying by us though bank. So we have the proof that we are the tenants.

Get the rent agreement executed and if there is no response, give notice for vacation of house.

Mr. Loganathan, Thanks for your valuable response. Our Landlord is not ready to provide any documents like rent agreement, receipt of rent etc. The only proof what we have that is Electricity Bill which used to pay by us through Bank.

You can submit an application to the Rent Controller as per provision of Delhi Rent Control Act.

You can go by the advice of Advocate M. Bhadra. You may also prefer to shift the house if in the absence of agreement rent is not accepted by cheque or receipt for cash is not given by the landlord.
