Delay condonation

my client received summons in Nov,2012 and accordingly he was added party to the suit.
he had already filed petition in High court against order dated 23/4/2012 by which he had made party for suit for specific performance of contract.

He informed the court on 15/12/2012 regarding filing of suit in High Court and demands adjournment. The court granted adjournment. after the order of High Court passed on 16/4/2013 the client appears in July 2013 for permission of filing written statement. In August 2013 when the written statement was bought for filing the other party take objection on the ground that there is delay. In september 2013, application for delay condonation has been filed and now the court wants evidence on delay condonation. please suggest draft of evidence in delay condonation.

Evidence to be adduced for delay condonation would be same as averred out in the delay condonation application itself.

You appear to be a new at BAR,it would be better to engage a senior for safe guarding clients'interest.
I say so because you are looking for 'a draft of EVIDENCE FOR DELAY CON DONATION' ?

Elaborate the reasons as given in the condone delay petition/affidavit in the form of fresh affidavit explaining the circumstances which led to delay. There are no prescribed format for this, moreover these thing are to be drafted on by own self so that the future exigencies can be handled accordingly.
