in our society in mumbai the builder has sold one part of the terrace front side to the flat owner and the other back side to left open step can one take can we file case on secretary for not taking action

1. A individual member cannot file criminal/any proceedings against the Secretary for actions of the Builder (who illegally sold the terrace).

2. Here the affected party is the Society and not an individual member. Hence only the Society can file criminal/any proceedings against the Builder (who illegally sold the terrace).
