Gpa sale + hiba sale (andhra pradesh)

(Querist) 14 October 2013 This query is : Resolved
Hello:

1. Is it possible to sell property in AP state with GPA(General Power of Attorney)? What conditions does the GPA needs to satisfy?

2. Is it possible to sell property in AP state with Hiba from parent to child? Hiba is on stamp paper but not registered. Any specific conditions Hiba needs to satisfy?

Thank you!
Pervez

Mr. Kumar, I am not sure what you mean by academic query. What facts do you need?

Its a developed plots property that our mother gave us through Hiba and also gave us GPA. The property is in AP state.

Thanks!

1. GPA would work if executed between family members.
2.Hiba need not be registered.

Dear Barman,

So property can be sold with an unregistered Hiba?

Pervez

Consult local lawyer.
Sri Vijayan.A (Expert) 14 October 2013
Mother has given the Hiba to her son/daughter.
Now, the son/daughter is the owner.

Who has given the GPA?
If mother appoints an agent through GPA, it wont work.
If son/daughter appoints an agent through GPA, it would work.

So, consult a Local Lawyer, along with all related papers.

The gpa is given by mother herself. Hiba and gpa both to her son just in case. So is it possible to mutate the property in my name?
Devajyoti Barman (Expert) 15 October 2013
yes.................
