i have to file a complaint at consumer forum in delhi against a mobile company whose mobile crashed within two months and service centre is keepng it since one and half month as they r not receving the part. they r not communcating with me nor responding to my mails.
the mobile company does not have office in delhi but in gurgaon and i have ppurchased mobile online. there service centre is a tie up with another company

contact a local lawyer in gurgoan for filing complaint . before filing complaint issue legal notice to service provider . it will save you the expense of legal fees

but why cant i lodge a case at delhi as iam residing in delhi secondly i had inform them overmail 15 days back that if they do not returm my mobile or money within seven days then i will approach CF

The Lawyers fee and the time taken in the case may be equal to or a bit less than the cost of mobile.
Consumer Forum may take 1-2 years (in Gurgaon it is 2-3 years or more)to decide the case on merits.
You may try again and if no result Consumer Forum is the alternate.

company head o is in banglore and one office in gurgaon but not in delhi....service centre in delhi...
mobile cost is 10K does it take so long in CF and what will be appox lawyer fee??

You can file case in Delhi if the mobile company has its branch office there. Read section 11 of the Act. It is clearly spelt out the places where the consumer cases can be filed.

Lawyers fee differ lawyer to lawyer. The cost of mobile is not enough for a financially viable complaint. In case of some principle involved away from cost viability, Complaint may be filed. Notice may be served.

The author had purchased the mobile by online. So, the jurisdiction point is not clear. He is helpless.
My advice is to open the online website from which the author had purchased and check up the address details of the online trader.
In case it is not found, the legal notice can be served on the branch office of that particular company mobile, i.e. either in gurgoan or delhi.
