Dear experts,
My grandmother wrote a will when I was around 4 years old, mentioning my name as Goutham Ganesan, now I am 28 years old but in all my certificate my name is mentioned as Goutham, Now i want to get patta for my property. Due to the difference in name the Thasildar is refusing to grant patta. What is the remedy?

Swear an affidavit before the 1st Class Magistrate stating the similar identity of names.

You have not mentioned when your grandmother expired which is vital matter fully ignored by you.
It shall be better to serve a legal notice and on expiry of this period to file a civil suit which shall eradicate all problems of name and delay, if any.

It is also advisable to publish in the official gazette of your state government regarding the change in name, and then to sear an affidavit in this regard as advised by the experts.

It is necessary that you satisfy the Tehsildar about your identity. An affidavit by you and your near relatives confirming that Gautam Ganeshan mentioned in the will is you, and that Ganeshan is your father's name. You may also produce your birth certificate where your father's name is shown. I think this should serve the purpose. You may disacuss with the Tehsildar also about furnishing of the affidavits as mentioned above. If the t
ehsildar refuses to accept the affidavits you may approach the Collector for relief.

Dear sirs,
I would like to inform you regarding certain issues regarding my query:
I was advised by a couple of advocates that:
1) Publishing in the gazette regarding a change in my name from Goutham Ganesan (as mentioned in the will) to C.Goutham (as mentioned in all my certificates) is not possible since I do not have any proof supporting my name as Goutham Ganesan (the only place where this name is found is the will).
2) They also suggested me in order to accquire the property you should change your name to Goutham Ganesan (as mentioned in the will)from C.Goutham & remain as Goutham Ganesan forever. Remaining with this name (Goutham Ganesan) is something which I and my mother do not prefer. So we did not like this suggestion.
3) They also suggested me that if I approach the Court and try to receive an order from the court in my favour, the Court will order my grandmother's will as invalid since the names are different.
4) My Father's name is Chandrasekaran, I have been referred in the will as Goutham Ganesan Son of Chandrasekaran in the will. (Name in all other records being C.Goutham Son of Chandrasekaran)
5) The will has been written in favour of my father's son (ie myself) and my father's brother's son. Both of us to share the house property into to halves.
6) This will was written by my grandmother was registered during 1990 and my grandmother expired 2 years back and only at that time we came to know regarding the content of the will.
Kindly advice suitably,
Thank You,
C.Goutham
