Anticipatory bail

when we should apply for regular nail if anticipatory bail is already given.

There is no need to apply for regular bail if anticipatory bail given. after anticipatory bail the court will direct to surrender to the lower /trail court within one/two weeks along with surities. on the same day the executing court will after getting bond release the surrendered person.

recently the Hon'ble SC has already cleared the law on anticipatory bail and has held that there is no need for seeking Regular Bail once AB has been granted and it shall run through out the trial....however the same may be cancelled as per the law.

However, bail bonds need to be furnished in court when chargesheet is filed and you are summoned or anytime prior if directed by the court granted AB.

To avoid any complications one should go for regular bail immediately after getting AB.

while SC has ruled so there is a sound input
by Mr.Arun kumar Bhagat,nothing wrong as the bail could not be denied in view of SC judgement and simultaneously if some default during proceeding or in case of conviction taking place, no sudden new scenario of surprise emerges with a question how to meet that?.

sir , as directed in the anticipatory bail order , appear before the concerned judicial magistrate and execute the required sureties as directed in the anticipatory bail order and gets yours self free from the apprehension of getting followed and arrested by the police. The question of getting another regular bail as earlier directed by supreme court is now not in practise and you are not requried to go for yet another round of regular bail in your case . yours advocate bhaskar p

As far as West Bengal is concerned the High Court itself provides the time within which the regular bail needs to be taken.

So here in West Bengal it is still mandatory and time bound.

As per the rule position cleared by Hon'ble Appex Court recently there is no need to apply for regular bail once AB is granted if not specifically provided in Ab order or provided by law as per state ammendment
