Increase in rent

Sir,
My father own a house, in that property my grandfather give ground floor on a rent but those days rent charges from tenant only Rs.20 pm. The same rent is continued till date and tenant was also not staying in that property for more than 7 years. Is there any right to increase rent.

It is better to get eviction of tenant by filing a rent petition before rent controller of your area rather for fixation of fair rent. As the property is abandoned since last 7 years and you also need it for your own use so move ahead and get fruits of your own property.

Where is the suit property situates as the Rent Act differs from state to state.
In Bengal there is a provision for increase of rent .

I agree with advise of Mr. Makkad ,almost in every State Act, a provision of eviction exists,enge a lawyer of your district to check with your ground available to you.

If your area is covered by Rent Control Act, you can file a petition before the rent controller, for eviction of the tenant, on the ground ceased to occupy.
Till the disposal of the case, you can pray for deposit of rent in the court.

Mere fact that the tenant has not been staying in the property may not be a ground for eviction. There should be a default in payment of the rents. This would be a ground for eviction. If you are in need of the premises u can also add this as an additinal ground for seeking eviction of the tenant. Better file a suit for eviction on the above grounds, instead of asking for fixation of a fair or increase in the rent.
