Issue regarding p.f

(Querist) 24 December 2013 This query is : Resolved 
Hello Sir/Mam
• I workd in domestic bpo(pvt. limted) they deduct p.f amount from my salary
• i resinged from my services one year back.
• Whenever i call to co. H.R told me “co. Ka abhi pf account nhai open hua hai isi bajha se ap p.f k liye apply nai kar sakte”.

Plz tell which option is available for me as per law. I hav no law background.

you can write to regional provident commissioner complaining against said organisation . you can also move consumer forum for necessary reliefs if provident fund commr does not take any action

Lodge a complaint to Regional Provident fund Commissioner. Send copies of your payslip. deducting PF and not depositing with EPFO is criminal activity.

Ye amnat main khyant hai aur ye criminal offence hai. aap paisa katne ke bawjood aapke khate main jma krane ki bjaye ve apne paas bina aapki likit permssion ke rkhe huwe hain. Isliye ap police complaint bhi kar sakte hain aur PF adhikariyo ko to complaint aapko lgani hi chahiye.

sir co. ka kehna na unka(co. ka ) pf account abhi open nhai hua hai.epfo ki taraf se delay ho raha hai account open hone me..bt p.f ka paisa co. ne deduct kiya hai every month..

Any proof showing the deduction. Form 16 if showing will also serve the purpose, apart from it, salary slip, appointment letter, relieving letter (If having any reference, though doubted that it contains any reference of PF deduction), any correspondence in this regard would support.

should i direct lodge a complaint or should i give a notice to the co. regarding my this activity.

Submit a letter preferably by redg. post addressed to the appointing authortiy, MD and demand to supply by redg. post the PF number, PF a/c slips of whole tenure of service, salary slips of all months of employment.

If the company continues to give verbal response only then you should without delay lodge complaint with RPFC in writing under acknowledgment.

It is better to transfer the PF a/c to new employer (whenever it is opened) and keep it regular for 10Y and be eligible for pension.

There are many benefits of keeping PF a/c regular.

Has the company provided any ESIC number/Card also?

ESIC is applicable for all employees drawing wages up to Rs.15000/pm as per def. of the wages in the Act.

There are many benefits of ESIC and no private health insurance an match it.

ESIC shall continue to give coverage to self and spouse even after retirement, dismissal and the children are eligible for admission into medical colleges of ESIC.

No need for notice.

It is offence under EPF act 1952 if your dues are not deposited. lodge written complaint with RPFC.


It is also offence under section 406/409 of IPC (cognizable and non-bailable) you can give FIR in thana where BPO is located, if you have proof of deduction and non-deposit.
