Divorce on mental cruelty

Recently I have filed divorce on mental cruelty ground. I have a son of 12 yrs old. Will it help if my son agrees that what I am saying against her is true infront of the judge? Will it help if my son wants to stay in my custody? How can I bring back my car registered in my name from her?

In the suit for custody of the child it is very incumbent upon the Judge to know the wish of the child in custodial maters.
However the Judge is not bound to go by wish of the child though his wish is favoured a lot.

1. child can be a witness and you may produced him as your witness against your wife before the judge.

2. because the son is 12 years old hence his will and wish will be prime concerned and his welfare is prime object of the court, if after his statement regarding living with you, the court think fit that you are the best person for his welfare then pass an order for his custody to you.

3. legally, you should file an application before the court for recover the Car from her if she is possession.
