(Querist) 04 October 2017 This query is : Resolved
My husband was expired in July. He used credit card . After his death who is responsible for his debts. Wife or legal heir authorities? In bank they said legal heir is must for repay the loan like jewellery and vehicle loan. But in credit card they told wife is the responsible person. Please clarify my doubt.

Any joint holder?

Any guarantor?

Any insurance attached to the card?

Have the credit card company asked wife to pay?

If so reply through your lawyer.

Debt can be recovered from the assets of the deceased through heirs.

@ Rajendra K Goyal,

Very vague advice on your part!

As per your advice, if the credit card company has asked the wife to pay, she should reply through her lawyer. You have not advised, what actually she should reply and for what specific purpose to be served with that reply?

@ Bharathi,

What do you mean by "wife or legal heir authorities"? If you are wife, is there any specific reason that you do not consider yourself as legal heir of your husband?

If not divorced or you have inherited his property, legally you are liable to clear debts of your husband. Otherwise, whosoever inherits the property by virtue of will or succession certificate, he will be responsible to clear your husband's debts.

The legal heirs are required to make good the debt of the deceased against the estate inherited. Everything depends upon the facts and circumstances, which you have not disclosed.

Go thru the Card statements and check if any insurance is provided with it and premia is charged. If yes; the CC company may appropriate the amount.

The debt can be recovered from estate of deceased.

The one that gets the estate of deceased may pay from the estate of the deceased..

Why did you repeat same query?
If you are not satisfied with FREE advise, consult a local lawyer and proceed.
However, estate of deceased has a charge over the Bank dues.
