Credit card dues payment - reg

I took a credit card from SBI in the year 2003 and used the card for purchase of some items for which a statement was received with interest. While taking the card the agent said that there will be no interest from date of purchase to 45 days. When contacted the call centre they said that interest is free for 45 days from date of issue of the bill. I asked them to waive the interest since the agents' version is different from them. But no vain. Treating this as unfair I paid the bill amount excluding the interest and cut card diagonally into two pieces and thereafter I never received any communication /approached by agent from 2003 to 25th june 2013. Today I received a notice form Newdelhi based lawyer with a request to reconciliation at Visakhapatnam and threatening to take civil criminal action.
What is the course of action I should take and what is the protection i have from the Law such as limitation. The amount due as interest is nearly Rs.400 - 600. at the time of card surrender i.e in the year 2003. But the amount mentioned in the notice is Rs.21,594/-. I am herewith attach the notice received.

Could you say what is the difference in the version of the agent and call center.

Did you inform them of destroying the card? Is it done with the procedure prescribed by them?

I suggest you to contact a advocate of your locality for settling the matter.

claim would be barred by limitation . you have admittedly not paid any dues from 2003 till 2013 . nor signed any acknowledgement of liability .

1) The agent at the time of issue of card intimated that interest will not be levied from date of purchase of items through credit card. Whereas in the bill the interest is levied and immediately contacted the call centre who intimated the interest will not be for the purchases from the date bill to 45 days.
2) I informed the call centre of destroying the card.
3) Am I supposed to approach the reconciliation meet as per the notice issued by the Counsel for SBI credit card or ignore the notice or I send notice to the counsel stating the law of limitation, If I attend, is it tantamount to acknowledgement of debt.

you have to take the call . claim appears to be barred by limitation . dont give any acknowledgement in writing wherein you admit your liability to make payment .

Well advised by the experts, Fully agree with the advise.

When the card destroying was informed to call center, whether they gave any ticket no. regarding the information given by you and noted by them. If not you should have confirmed your information by letter.

No one can legally force a time barred debt, However, this default in credit card may spoil your credit history with the CRISIL.

can the case be filed at Newdelhi. If so what course of action the courts will do and whether the courts decide without considering the limitation. Can i ask for the staement from the credit card bank/the advocate who issued notice without any details but mentioned the amount only. If I ask the staements for verification is it amount acknowledgement of debt. Can the Jurisdiction for credit cards limited to particular place. Can I proceed against the credit card company at my place.

when you had taken the credit card you had entered into agreement with SBI . the agreement must be containing clause as to jurisdiction . wait for bank to file case .it is the duty of bank to forward detailed statement of account regarding credit card dues . if bank has not forwarded you any statement you can ask for statement . now days you can download your credit card statement online from bank website if you have availed internet banking .
