Dear Lawyers,
I have a query with regard to obtaining copy of document for my property. The property is registered in the name of my father. After his death it has been transferred to my mother’s name. I and my younger brother is planning to build a house in that area and for which we are planning to get a settlement deed from my mother. But unfortunately the property document has been misplaced. When i checked with few legal sites in Google it has been mentioned that for applying the copy of document you need to file a FIR with the nearby police station with all the copies like Up to date EC, Property tax receipts etc., and then to publish an advertisement in local newspaper with the help of a lawyer. But when i consulted few lawyers referred by my friends, they advice that filing a FIR copy is not required if you are going to put a settlement deed.
I am little confused on understanding what is the correct procedure, Request your help in understanding the same

you may file a simple application under right to information act enclosing rs.10/- as court fee stamp and mention the exact details of copy of document requireed.you may submit the said application to the information officer of the collector office in the area concerned where the said property was registered.
your purpose will be served.good luck.

If you know the s.no,plot no. of the property you will get at city survey office or patwari concerned. for settlement deed you will get certified copy of deed in sub registrars office.

First of all your mother is not only entittle to hold the property. Being a legal heirs of your father along with your mother, you and your brother are entittle for the equal share.
If you lost the original regd., sale deed you need not to file a police complaint, just file an application for the certified copy along with the property No. date of purchase , you will get it.

There is no need for FIR
You can apply for certified copy with the sub-registrar office concerned you will get it.
Go to the office, with the details of your property, they will help you to get it.

If you have the particulars of the registration then you can get the certified copy from the registrar office.

Obtain certified copy of the title documents from the concerned Registry. Also obtain EC. Then you may proceed for settlement deed.
