Consumer court

(Querist) 13 March 2013 This query is : Resolved 
Hi, I need to know the procedure of filing a case in Gurgaon counsumer court. What will be the fee and how much time will the case take to close. Will I need a lawyer or I can adress the case myself.. Also if someone can tell me the whether the consumer court is the the mini secretariat complex of Gurgaon.

No particular format is prescribed for filing a complaint. A complaint can be filed even on plain paper. The services of an Advocate are not required. Complaints, where the value of goods or services and the compensation, if any, claimed does not exceed Rs. 20 lakhs, can be filed before a District Forum where Opposite Party resides.

Complaint can be registered within 2 years from the date on which the cause of action hadarisen.

You better contact the local consumer office. You need not engage an advocate and if you seek any help they would provide you the format and other information you are looking for.

Court Fee for filing a complaint is as follows:


Before District Forum:

For claims up to Rs. 1 lakh = Rs. 100
(FOR COMPLAINANTS WHO ARE UNDER THE BELOW POVERTY LINE HOLDING ANTYODAYA ANNA YOJNA CARDS - NIL )

For claims from Rs.1 lakh to Rs. 5 lakhs = Rs. 200

For claims from Rs.5 lakh to Rs. 10 lakhs = Rs. 400

For claims from Rs.10 lakh to Rs. 20 lakhs = Rs. 500

first you should make a detailed complain to the authorities of the goods office were you bought the goods and if you have no response even after 15 days then you should complain in the consumer court with your detailed complain letter with xerox copies of the bills and any correspondence if any at consumer court and as said if the amount exceeds then at district forum

The Consumer Forum fee in Haryana is Rs. 100 for the cause of action of Rs. 1 lakh, Rs. 200 for 2 lakh, 300 for 3 lakh, 400 for 4 lakh and 500 for 5 lakh to 20 lakh.

Consumer forum is situtated within Mini secteriate campus in Gurgaon near Rajeev Chowk, Sohna Road.

You can also file your complaint but better to hire the services of the lawyer.
