Dear All,
Please answer my question with base of it if possible:
Whether compromise amounts to convection, specially in case of 138 of NIA.
If yes, which party will be assumed to be convicted in the eye of law.

You can say compounding. If both parties come to a mutually agreed settlement, then they can approach court for compounding of the offence.
S.320(8) of Cr.PC states that the Composition of an offence under this section shall have the effect of an acquittal of the accused with whom the offence has been compounded.
