Compassionateground appiontment

respected sir my father worked as a assistant agri officer in chengalpet he was expired while he was in service in year 2005 my mother applied for that job but till now she doesnot deserve any job now she is 56years old,i applied for that job but agri director rejected my application,what can i do now?

Why did not take steps last 10 years, if they not consider your mother application immediately you should file writ petition or filed CAT, any way pls call me, I am from chennai.

First of all, obtain the relevant information, such as - why your application was rejected, why your mother's application was not considered and particulars of compassionate appointments, if any, during the period etc. under RTI Act and if there is any irregularity, seek judicial remedy. You can approach the CAT only if your father was employed with the Central Government.

Pl. note that compassionate appointment is not a matter of right.

I agree with the explanation provided by the expert MR.Venu. It is not a matter of right. As per the information your father is a State Govt.Employee of Tamil Nadu State. Your father's colleagues can help you with the existing provisions as regards compassionate appoints in the Department. Be in touch with good friend of your father who can help you to some extent. . You can meet the Director personally and ascertain the reasons for rejection. Ascertain the reasons for not considering your mother's/your application by sending an application under RTI Act. Also seek the details of compassionate appointments that were given in the department for the from the date of death of your father

You have not stated (i) when your mother allied (ii) who decided she is not suitable for job (iii) when did you apply (iv) How old are you (iv) are you working (v) why you did not apply in 2005 (vi)how much qualified are you (vii) for which post you applied

The case of your mother for compassionate appointment, which is not a matter of right, should have been expedited, which is becoming redundant with the passage of time since she is attaining the age of retirement even without being appointed.
Seek help from local lawyer and the colleagues of your deceased father.

I am sorry. I have gone through the judgement quoted by Mr Issac Gabriel. This pertains to a case where a compassionate appointee was terminated without notice for having got the employment by hiding fact that his brother was employed in Govt.

I am not able to understand as to how this judgement can be of help of this querist whose case form compassionate job has been rejected.

He is yet to disclose full facts of the case

I reterate.

the decision of the deptt is wrong. SInce they claim (rightly or wrongly) that they did nto receive any certificates, the claim of your mother was not considered. You can move to SAT/High Court as the case may be.
