Can a joint pension account be withdrawn by wife

I hold a Joint Pension Account with my Husband and my Husband is a Pensioner and he has Deserted me at this age now and he has a put a Hold on the Joint account that i cant withdraw my Money from the Joint account which i hold with him and the Bank says he is the Primary Account Holder and i as joint Account holder in a Pension account dont have any Rights and how can i send a Notice, since my Husband has Deserted me at this Old age and he being the Pensioner he is withdrawing all the money and i am not able to stop this nor receive any Money from the Joint Pensioner account. Since the Bank is totally Supporting him and says he being a Primary Account holder and he has the Entire Rights too and now all of a Sudden my Husband is Transferring the Joint account to some other account of the Same Bank in anther place so that i cant Claim any Rights. How can i Legally Challenge this, Please advise me

You may legally move for your subsistance, sincc there is no joint pension account.

How did you hold the pension joint account with your husband? Or is it an SB joint account? Consult a local lawyer to file a case if necessary.

After repeated reading of your post, it is not clear as to who is the pensioner, whether you or your husband.

If you are pensioner then you can change pension account.

If husband is pension then bank is under no obligation to give you chance of get subsistence. They have full obligation to allow him to transfer money to any account as soon as the same is credited.

What is the style of the account?
Whether it is “either or survivor” or “former of survivor”?
In a joint account anyone can freeze the account. You should Write to the Bank to stop any withdrawal till the same is signed by both.
If the Bank is not cooperating, even after giving in writing, issue legal notice and file case for court directives and for temporary stay on operation of account till decision.

If husband is pensioner, he can direct Bank / concerned DDO to credit pension in other Account.

Discuss with an Local good Advocate and move for legal remedies like Maintenance. Senior Citizens have Priority in Court Cases also and request your Advocate to file a separate Petition along with other petitions for the pleadings based on the Senior Citizen . Your case could be completed at the earliest. Discuss with an Local Good Advocate.
