Rti opinion and advises

Sir,
I approached Sub Registrar in Tamilnadu seeking certain information regarding my land sales.I asked the queries and asked them to clarify my queries through the information available in Government records. But the PIO replied to all queries that "Opinion cannot be given as per RTI act" and rejected my RTI application. I asked them to clarify my queries but the PIO gave reply like this. Does Opinion and advises cant be seek through RTI?. Kindly clarify my issues..


I asked the following queries under RTI
1.Whether Patta will be considered as a Title document?
2.Who will be considered as a owner of land. WHETHER the name of person in Title deed or name of person in Revenue documents?
3.Do revenue documents is alone accepted for land registration?

For all the above queries the PIO replied Opinion cannot be given under RTI
Government definitely might have setup rules and guidelines for land registration. In those rules the above queries might have answers.those can be given as information right.

Kindly clarify it please

Compassionatw appointment

The Government has issued orders providing compassionate appointment to the wards of cooperative society employees who die while on duty. An employee who had worked continuously for 20 years dies while on dury. The retirement benefits,ie gratuity,pf,leave encahment have been rightly paid.But refuse compassionate appointment to son stating that the head of department has issued circular to refuse compassionate appointment that the deceased employee ,though put in 20 years of service was not regularised till his death.. Whether cicular can override the Government order? Is there any chance to get compassionate appounment?Experts please help.

Forming of sub - committee

Respected Sir/Madam,

I would like to know who can be appointed as a sub committee member by the managing committee in a housing society in maharashtra.

The managing committee has appointed someone in the sub committee who is merely staying with his parents and is not the owner of the flat and only recently was made a nominal member after his appointment in to the subcommittee. Is his appointment legal.

In the last AGM the person who was not the owner of the flat but was only staying with his parents came to attend the meeting and had not registered his presence in the AGM register since he has no right to vote in society matters but was made a subcommittee member. Request you to please let me know if this is legal.

Property registration value

Namaste sirs

The government guidance value of property is 23lakhs for which buyer inccur 1.5 lakhs towards registration

The market value is 36 lakhs

Now if i take DD for 36lakhs will registration charges exceed beyond 1.5lakhs at buyer end

Please guide ME

Bank asking forecloser charges

We were enjoying cash credit limit from axis bank since 2017 and now on 15 august 2020 it was due for renewal but now we don't want to renew the limit and close the limit , we have already paid all the dues . We have ask bank for closer of limit in reply they are asking for foreclosure charges I want to know can they ask for any charges as at time of renewal we asking closer and not in between of the limit and we paid all payment by own fund and there is no take over of limit And bank is not giving proper reply and keep on delaying So what should I do and are they liable for any foreclosure charged Please guide me

Drt surfaesi act related quarry

Dear Experts
I baught an NPA property in an auction under SARFAESI ACT in 2017. Bank auctioned property on symbolic possession basis. I still have not get physical possession and case is in DRT. Now after 3 years, bank is feeling case can be dismissed against him due to non compliance of procedure. Bank published auction in two newspapers, sent sale notice, affixed symbolic possession notice on prominent part of property. but they did not serve 13 (4) notice by registered post. Now court has asked bank to show compliance. My question is.....what if bank is defeated. bank will go to DRAT or will do re-auction of property . My 2nd question is as a buyer how much interest i should be paid by bank if money is returned to me. is auction buyer have any rights or can take any action against bank for not providing physical possession.

Society not transferring flat

Respected Experts please guide me
My Unmarried Aunty ( Dad's Sister) died in the year 2017,She was living with her cousin at the time of death. She owned a house (self acquired) in a Co-op Hsg. Soc. Ltd. and currently the house has been let out to tenants by my aunt just before her death. After the demise of my aunt I approached the society and met the secretary for the transfer process of my aunt's flat, she told me that after discussing with the chairman of the society she will get back to me, but since I never received any kind of response from her end I approached her again and then she tells me that the society does not recognize me and will not entertain me and will transfer the flat to a person whom they know. So I requested her what documents will be required to prove the relationship between me and my aunt. She just slams the door and doesn't even answer my call or even reply to my messages.
Please guide me on what document would be required to prove the relationship between my aunty and me and whom should I approach to complete the transfer procedure and approximately how much time it would take for the transfer procedure

Regularization of notarized lands

Sir What is the procedure if a person has transferred the possession of property through notarised document. and the property is a domestice residential land property where he is living from the past 40 years and wants to regularize that land on his name?

Pls suggest what are the legal options available, Construction of House already done but he wants the land to be regularized and ready to pay the Prescribed Property Tax and other Fee to the Government
