Hello Respected Advocates,
My maternal grandfather has some ancestral land in Haryana, and he is living.
In 2015, My mother filed a suit for declaration and injunction for the ancestral property in Haryana. The suit got dismissed in 2018, on the ground that " mere suit for declaration without possession is not maintainable".
Then my mother didn't appeal.
Yesterday, we met a lawyer, he said " that declaration case is not maintainable, you should have filed a partition suit directly" and he is saying to again file a case for partition in the lower court.
Is there anything in Law, that in ancestral property cases first declaration case has to be won then partition suit has to be filed?
Dear Experts, can you please guide me, is it correct?
How Is it possible to revive the case now?
Abhishek

Private Bank shared account number with third party without consent from account holder. What action account holder can take against Bank ? There are valid evidences of sharing account number with third Party.
In order to counter this step of Bank, account holder posted messages against Bank on Social media and other public platform. What steps a private bank can take if someone post defamatory message against Bank on social media and pump-lets on public places etc?

Hello Team,
We recently tried to rent out an apartment in Hyderabad. The total amount of deposit was 50 k and we paid 10 k as token amount. 1 week before the move in date, the owner demanded that we draft the rental agreement with a lawyer ( that stays near us ). We stated that this would not be possible due to work hours and the delay in overall procedure ( since they mentioned earlier that they would be the one drafting it out ). In conclusiveness, the owner cancelled the plan to rent us the room and refused to return the token amount (10k ). We also paid 4k from our pocket to get the cleaning done. While we do not have MoU signed, the amount was transferred via bank. If we opt to take the legal pathway, would that play in our favour or rather how good chance do we stand?

Hi,
We are four brothers and we have 30 acres of land and out of it 12 acres is ancestor property and the rest 18 acres is bought on my money as I was a working person alone in the family and the rest 3 are looking after the land in the village and we were not separated till 2018 and in 2019 we got separated and our ancestor property was divided with 4 brothers i.e., 3 acres each and rest 18 acres have been registered on my name and their willingness also have been asked as the other 18 acres was purchased when we were together and they had no dispute in this matter.
Its been a year we have separated and we wanted to develop the land now, but now they are asking for equal distribution of land as it was purchased when we were together and they are approaching the court for it
Kindly help me with the legal procedure to protect my property which was purchased by myself.
