Learned Experts,
I have filed a case in CAT and appearing in person. Rules are unclear about affidavit in support of the miscellaneous application. Matter was adjourned with instructions for one week as respondent lawyer wanted to seek instructions from respondents. However, on the date which matter was fixed, was declared holiday and matter is shifted back two months.
I wish to file a miscellaneous application seeking early hearing especially on interim relief prayed for. i need the following guidance serially.
1. Does miscellaneous application requires affidavit in support?
2. Application is supposed to be served on respondents as well. Am i required to submit proof of service as well along with application? If yes, in what format or form?
3. How many sets of application i need to submit before CAT?
4. Is there any other documents need to be submitted along with application?
5. Can anyone share or point me to the format of early hearing application in files section?

Respected sir, I gave legal notice to my mother and sisters for partition of movable and immovable properties which are on my father name.There was no any veelunama or any other.according to my notice I got reply as I have no objection to give house with site (item 1)after the death of my mother subsequently sisters are ready to pick vacant site (Item 2)as theirs share.Now I can give another notice to partition all properties as soon as possible,because of my health conditions, financial condition and my family members better future.Can metion as it any damages to my shares and my family then are responsible.Give better advice

Dear Experts here,
I had purchased a second-hand car from a person, I have the car in my possession but the title name on the papers are of the same person from whom I have purchased, money has been transferred but the problem is the person is not transferring the vehicle in my name and giving me the papers of the vehicle so that I can myself transfer the papers in my name.
Please advise me can I go to the police station and complaint? or let me know some other solutions.

My brother get a land from my father by gift deed which is within the house where I reside. The land was registered without my knowledge.
Now my brother want to sale the land. I offer him to sale the land to me at valuation price. He asked double rate of present market valuation.
If the land is sold to other person, can I raise objection & file any case ?
We having 87 plots in our colony layout which was laid in year 1975 by Housing society through panchayat approval, one plot its approach was stopped using it due to two plots gave their plots for development and took its entrance to other side in 2014 approach way was sold off by housing society representative showing as plot do it is authorised to so

I have had filed a petition for fair rent u/s - 17(6) of the West Bengal Premises Act in 2014 before the Additional Rent Controller at Alipur judges Court, Kolkata. The defendant is my tenant. The matter is still as of sub judice since 2014. The hearing date for fair rent fixation was fixed several times. But due to reasons like the opposite party was sick, the post of the ARC was vacant for a long time, then came the COVID-19 pandemic, till date the hearing never happened. Furthermore, after searching rent records, if it found that the tenant has not deposited any rent with the Additional Rent controller ( the previous old rent amount, the postal money order of which I refused earlier ) since 2014, I filed the suit for a fair rent. Could I file a suit for eviction in another court at the same Alipur Judges Court, on the ground that he has never tendered any rent deposit since 2014 with the Additional Rent Controller, nevertheless, the suit for fair rent fixation is still sub judice with the additional rent controller, Judges court at Alipore, Kolkata?

Can you please let me know the procedure to transfer the SRA flat on my mother's name, as my father died few months back with heart attack.
No Nomination or will signed by him.
Will be helpful to know the list of documents to be present at SRA office & Society office.
Maintenance charge by rwa on uds or flat basis
I am an EC member of RWA an apartment in Chennai Tamilnadu. Our Association charge part amount variable on UDS basis and the Security, Office Staff Salaries, Lift AMC charges, Auditor fees are on fixed basis equally to all flats of 520 sqft to 1661 sqft as per a Resolution passed in AGM. Some aggrieved members quote Sec- 3i of TNAO Act 1994 which says Administrative, Maintenance, Repair & Replacement expenses are Common expenses. Hence as per Sec-19 these common expenses should be shared according to the percentage of Undivided Interest for each flat and on variable ie UDS basis and the Resolution is arbitrary and violation to the TNAO act 1994.
I like to have clarification on legal basis the validity of the Association method of charging Or the aggrieved members contention.
