Right to pass on property share

We are a Hindu family from Andhra Pradesh. My husband passed away recently at age 89. I am aged 87. We have a son and a daughter. My husband and our son partitioned their ancestral property in 1986. Son misused his father's share for business finance and lost all of it. He also sold father's self-acquired property. His own share of ancestral property is intact. The son died in 2002, without leaving a will. My daughter is our only surviving child. The son is survived by his wife and three major daughters. I understand that the mother is entitled to 1/5th of son's share of property. Last 12 years, son's widow has flatly refused to support us or to give me my share. She is now saying she will do it, but adopting delaying tactics. My daughter and her husband have been maintaining us, eventhogh we did not give them anything. I am anxious to pass on my 1/5th share of the property to my daughter by a will or deed. The question is: can I will my share of the property to my daughter without a partition deed (which the daughter-in-law is avoiding)?
Thanks and Regards.

Mortgage ny nri to foreign national

An NRI wants to mortgage to a foreign national of non Indian origin based in UK, his residential property in Mumbai, for the purpose of acquiring another property in UK.

Can he mortgage the property? If yes, on default made by NRI, will such property be transferred to the foreign national? Can the foreign national hold such property.

Input tax reversal

My client is situated in West Bengal and makes purchases from Local, centre as well as imports. He sales the goods in the local market and stock transfers goods to his head office in other state. He is able to determine the purchases(whether purchased locally, centre or import) which is stock transferred against Form F. My question is, for Reverse Credit do I have to consider the entire stock transfer (including local, centre & import purchases) or only the local purchase is to be considered.

2. How the Reverse Credit is to be calculated in following case: -

Local Purchase: Rs 26577318 itc Rs 1328866
Central Purchase: Rs. 5102330
Import: Rs. 245870/-

Local Sale: 11767178 Output Tax: Rs. 588359
Stock Transfer (from local Purchase): Rs. 14927220
ST. (from Central Purchase): Rs. 4369134
ST (from Import): Rs. 60519/-

Total Sales: 31124051/- Output Tax: 588359

Solution to the query will be highly appreciated.

Addition of trustees

A charitable trust was incorporated in 1960 in Old Delhi. The trust purchased a building and sub let the same on rentals.

The trust had 6 founder trustees all of whom have since been deceased/expired. Two trustees were added in sue course in year 1980 and are still alive.

As per the trust deed there should be at least 5 trustees in the trust.

Q1. How can the new trustees be added to the trust.
Q2. One of the deceased (founder trustee) who passed away this year has written in his will to include two persons as trustees.

Please advise.

Solution for further step in 498 a

Respected Experts

My query may found for some of the experts as a repeated query but please I urge because I need your favourable replies

My wife filed 498 A against me, my father and mother in Feb' 2011.

I filed for quash in the year 2012 in high court where i got failed to prove that her 498A case is false and lost the quash u/s 482 cr.p.c.

Now in 2015, after struggles alot using RTI Act, got every information as proof now I filed discharge petition u/s 239 cr.p.c.and proved that entire chargesheet is false and got succeeded here in magistrate court in where I got an order as my mother and father A2 and A3 got relieved and A1 myself left in the case.

Now apart from the next step here a trail procedure by defacto complainant here in this magistrate court, do I got an another chance in High Court to appeal or revoke the older quash by using this lower court order

Please guide me the proper way such that Incan get out of this case.

Awaiting for favourable replies.

Thanking you.
