we have filed execution of decree in specific performance of agreement case. Sale consideration is deposited in treasury after refusal of JD to accept sale consideration and draft sale deed is also finalized as per objection raised by JD's.
Now Court will be required to appoint Local commissioner as JD are not executing sale deed.
Do we need to create another draft sale deed to be executed by Local commissioner and also seek concurrence of JD or earlier sale deed approved by JD will suffice the purpose?
Earlier it took around one year to finalize this draft sale deed and do we need to spent all this time again in changed circumstances ?

please advise me how to change the place of birth in Passport. I had my first passport issued from Trivandrum Kerala in 1994 and it got expired in 2004. in That my place of birth mentioned is "KUNDARA". I have submited my 10th certificate for issuing the passport. in 2001 i made my birth certificate from where I was born, ie. "IPALLOOR". Both KUNDARA and AIPALLOOR falls under the same district KOLLAM and State Kerala. In 2015 i applied for renewal of my passport and as per the initial passport all the datas copied in that and Place of birth mentioned as KUNDARA only. Now when I was filling out my form for the immigration to USA I noticed the discrepancy in Place of birth. its diffrent in Birth certificate and passport which is not acceptable by US. So I applied for change in place of birth. Police verification done everything is perfect but now the RPO need an affidavit duly signed by Metropolitan Majistrate/Judge. I have approached so many advocates for this and they all said it can't be done.
Please advise me how can I get it done as I need the passport urgently for submitting DS260 form.
The RPO said I can't get it attested by a SDM,EM or Notary. How can MM/Judge will attest my affidavit.

My Father has Died in year 2001 in Amravati due to a disease
He has Ancestors Land near a village in nagpur which he has received from his father (i..e my grand father)
We are 5 sisters and 5 brother (total 10) and my mother is also alive
In year 2012 My 5 brothers sold that Land for 5 crores and divided (1 crore each) equally among them without knowledge of any sisters or mother
Now we all sisters came to know about this, when asked they said daughters don't have any right on fathers (especially ancestral) Land and legally no sister can make any claim
Is this True ?
Does daughter dont have right on ancestral
When My father was alive he said he want to give me some money after selling Land because my financial condition was weak but he died suddenly due to a disease before making any Legal Will (testament)
Let me know if this is correct ?
DO I have any right or not ?

My brother filed a partition suite against me and my mother,court sent summons by registered post to my own house which is locked from last two years due to allegations between me and my brother, my brother knows my new address also, but still they have sent summons to locked house, i heard about this summons from my relatives who are staying near to that locked house.
so do i need collect the summons from postman, or do i need to wait till they have send the summons to my current address?please suggest me...

I was contacted by a consulting agency from Delhi regarding job offer with Skoda. They even conducted my telephonic HR interview since I am from Mumbai. She colleceted Rs 30,000 from me also sent me an Offer letter in the name of skoda when I insisted. I couldn't suspet anything wrong since it had a logo and water marking of Skoda. But when the joining date was nearing I got suspecious since my technical round was pending and they started asking me more 15,000 for further proceedings which I denied. When i enquired with skoda i found it was fake and when i confronted them they have switched off their all numbers from last Friday. I enquired about that company and came to know its registered one in Delhi. I even send my relative to their address feom Ghaziabad but found its locked out since last saturday. What do I do now to get back my money.?? Please help.
My shop was built in June 1989. I let out the same in December 1989 with rent agreement which clearly mentions that Act no.13, 1972 does not apply.
-The tenant had not paid the rent since 01-01-2005 and the shop is closed since then.
-He was living in a rented accommodation in our town as mentioned in the agreement. I inquired about his whereabouts at the location mentioned in the agreement, but I found that he have left the town. His location is now unknown to me as well as the nearby residents & shop owners of that locality. This means he left the town without handing over the shop.
-I have discussed the same with a practicing lawyer. He said that you have to issue a claim notice to tenant & if he does not receive the notice then we can't claim your property in the court.
-Now as the whereabouts of the tenant is unknown to me as well as the nearby residents & shop owners, How can I claim my property back? What sections & rulings would be applicable?
-Also, if this tenant's location continues to remain unknown, then will my property remain in his possession, given that the shop remains closed since January 2005 & without rent payment?
I bought flat in redeveloped building in 2013, which got OC, and i got possession in May 2014. building has conveyance. now in July 2016 builder is getting us added as member in the same old society and not forming new society.Old society as it is will continue and thier MC members.
1. being added now as member which process is under way, can society raise monthly maintenance to us or not.can society raise bill as provisional members till the completion of formalities. we have submitted only form no 23 till date.
2. we have 21 flats and 7 shops in the building. Ground floor Shop owners are refusing to pay the monthly service charges equally by way of common electricity bill, Lift maintenance watchman salary and sweeper salary.as per bylaws same to be divided to all.can they refuse and get order from registrar or from court. pls share some case studies on the above matter.

CAT order in my favor 14 August 2015
Dept didn't implement.
I want to file contempt.
Learnt that dept filed (21 June) condonation of delay to appeal against CAT order in High Court. As on date (22 July) I didn't receive any notice.
Meanwhile deadline to file contempt is too close (13 August).
After I file contempt, condonation is admitted, my contempt petition will not be entertained.
If I wait and nothing is known about dept appeal by 14 Aug I forego filing contempt.
In a fix.
Please advice.
As per CAT Order there is no time period within which date CAT order was to be implemented.
Asked the department to implement the order thrice in these 11 months.
Remarriage
Iam a 52 years retired army person . iam married a girl sine 1984 September 9th . living with her up to 2001. She is a state government employee. Our marriage is not in registered. But my entered her name in my service record . two children's me. One son and one daughter. Son is 30 years he married .daughter is 36 years and she is married . we are seperated in 2001. After five years iam remarried and this married is registered . now my old wife is complaint through Kerala women's commission for my property. What can I do please help me.
