I am have charged with a chargesheet for RDA Major Penalty. Two charges have been made which are totally based on presumption.
Charge No.1
That, Sri Nabendu Mukherjee during the year 2014, while working as Inspector, CBI, ACB, Kolkata abused his official position and tried to broker a settlement deal in CBI, ACB, Kolkata office in a dispute between Shri Biswajit Pal (Private person) and Shri Mukundalal Ghosh, contractual employee working in CPWD, Central Division-III, Nizam Palace, Kolkata. Sh. Biswajit Pal alleged that Sh. Mukundalal Ghosh had duped him of Rs 42 lakhs.
That Sh Nabendu Mukherjee, Inspector, CBI, ACB, Kolkata later pressurized Shri Biswajit Pal for accepting a settlement deal of Rs 5 lakhs in lieu of the duped amount of Rs 42 lakhs and asked him to sign an agreement. In this regard Sh. Biswajit Pal had filed a police complaint against Sh. Nabendu Mukherjee and when Sh. Nabendu Mukherjee came to know of this, he threatened Sh. Biswajit Pal and also his wife with dire consequences.
By the above acts, Shri Nabendu Mukherjee, Inspector failed to maintain absolute integrity, devotion to duty and acted in a manner unbecoming of a Government Servant and thus, violated rule 3(1) (i) (ii) and (iii) of the CCS (Conduct) Rules, 1964 and thereby, committed gross misconduct.
Charge No. 2
That after receiving the complaint Mr. Nabendu Mukherjee, Inspector, CBI, ACB, Kolkata did not inform the senior officers regarding the complaint and proceeded to summon the accused. He had called Mr. Biswajit Pal and his wife Smt. Kakali Pal Sarkar and threatened them at regular intervals to settle the matter.
Sir, please help me to prepare the initial explanation to the charge.

Hello Sir,
My name is Larsen and my great grandma passed away in 1962 and her final burial rituals were conducted as per Roman Catholic law in one of the church in Mumbai. The concern is that this church doesn't have any proof of her burial and even we do not have any details of her death. my grandfather along with his two sons hv all passed away leaving behind a house which we are unable to register without a valid death certificate. We do have 3 witnesses that gave testimony about the burial n are advanced in years around 78 plus age. How can we proceed to legally obtain the death certificate..
Kindly advise..

Dear Lawyer,
We have purchased a flat in chennai from a builder 20 yrs back. That flat was actually booked by our neighbor in the beginning but after 2/3 installments we have purchased & got it changed on our name in builder's record. After full payment, flat was handed over to us without registration and we are residing there for these many years (till now flat is on builder's name). All the property taxes, water bill etc are regularly paid by us but only electricity bill is generated in the name of builder, it is also paid by us.
Recently we have asked the builder to register the flat on our name, but they refused to do it explaining that company is already closed 3 yrs back and we cannot do anything in this case. Now in these circumstances we are not in a position to sale the flat without registered documents.
Kindly advise how we can get the flat on our name, Flat is in chennai
Thanks

Hon'ble CAT decided that - "we direct the respondent to consider to upghrade the post of applicant from pay scale 6500-10500 to 7500-12000 as approved by the 24th governing body of department w.e.f. 1-1-1996. they are also directed to treat the post of applicant upgraded from the date the post of respondent 4 & 5 were upgraded. this exercise must be completed within 3 months and applicant shall be entitled to get all the consequential benefits after upgradation of his post w.e.f. 1-1-1996".
In appeal High court said that "direction to give the benefits on notional basis with effect from 01-01-1996 is also on the same line as per decision of the Board." we, therefore, find no fault with the order dated 20-09-2016 passed by the tribunal" with this clarification, the writ is disposed of.
respondent organisation sanctioned notional benefits up to 23.03.2014 and actual benefits w.e.f. 23-03-2014 but paid from 01-01-2014 and fixed wrong pay fixation and calculated wrong house rent allowance and on the basis of wrong calculation arrears were paid to the applicant w. e.f. 01-01-2014.
respondent submitted that we have compliance order and consequential benefits have been granted to him w.e.f. 28-03-2014 the date from which respondent no 4 & 5 were granted. on the basis of affidavit contempt petition was droped/dismissed by the CAT.
in this case my arrears/benefits (actual) was not sanctioned from the date of governing body decision, other side arrears already sanctioned to the my counter part for upgradation and given 1st ACP benefits above promotional post.
please guide me- 1. can I appeal in this case or if yes than in which court.
2. can I filed new OA for grievances regarding wrong pay fixation and wrong calculation of HRA.
3. any other relief how to get.

Sir ,
we have two properties ..one is 2.5 acres land in our father in law 's name ...another one is a house given to my father in law According to his father 's will....( My grand father in law will)...my father in law has 6 sons and 3daughters ..8 grandsons and 5 grand daughters. One grand daughter and 2grandsons are staying abroad ....at the time of registration is there a need of grandsons and grand daughters?
The form of nomination (bye-law no.32) for use chs at mumbai
1. I wanted to know why the above referred form which is available at many stationery shops in city of Mumbai is just published in "SINGULAR" that is : I shri/shrimati so and so etc.. and not as : I/We -------------- am/are the members of so and so CHS etc... as majority of the flats in Mumbai are invariably held in Joint names. I am seeing this format for the last atleast 40 Years. Why the Co-operative Department is not looking in such matters.???
2. When there are say 2 Nominees mentioned for a flat, the matter at Sr.No.5 of this form says that the "Property should be transferred to ______________( The first named Nominee on his/her complying etc.... So even if there are two nominees, the property will be transferred in One Name (First Nominee) only and not in Joint Names(That of both the Nominees). Assuming there are no other legal heirs, can the Society transfer the property in names of both the Nominees or only in favour of first nominee only. Please clarify.
