Dear sir,
We was appointed as sale promoter of a company in 1997 and at that time we had deposited Rs.6,00,000=00 as security deposit. Due to conflict the company had closed the business and files two cases against us under NI Act 138 without finalized any of accounts.
In the year 2003 they gave us a notice to confirm the deposits as on 31st march 1998 for income tax purpose.On the basis of that latter we filled a case for recovery of security deposits in court of law.
Now the company is saying that:
A. It is time bar case( Out of civil limitation)
B. They had forfeited the amount in sept. 1998.
Now the facts are as under:
A. There is no any communication about security amount from both the end till the date of first notice given by us in the year 2003.
B. In the reply of notice for refund they had not mentioned about the forfeiture
C.They had not produced any book of account about the security deposits( As they were maintains two books for their transaction one for business related and another for security deposits.
Can you help me in the matter by citing any of cases in this regards from any of higher court of India.

Hi,
I have passed my LL.B. degree in May 2008 from Mumbai University and have currently moved to the USA. Do I need to be physically present in Mumbai if I need to apply for the SANAD in Mumbai(i.e. Mah & Goa Bar) or is it possible to send my representative and the required documentation & fees. I need to apply for the California Bar exam and need to submit proof of admittance in India. Its not possible for me to travel back to India at this time. Also, I would be ok if I need to provide any Notarized Authorization (US Notary) to my brother or father to do the requisite documentation. Any advise or information would be greatly appreciated.

Hi,
Does anyone know about Fixed deposit holders' case related to Morepan laboratories?
I am one of the deposit holders and haven't received the refund yet. I came to know that court has directed Morepan to issue equity shares but I haven't received the shares yet.
Is anyone in same boat?
Has anyone received the shares?

Mr Ramesh, I am joyce, a lady. thanks for the reply. I know the meaning of juridiction, but in one of my case mvc is filed at other district where accident took at anothre distrct,& parties reside again in other different district, So hw can this petiton be tried? to be clear: Accident at Mangalore, parties resides at Bagalkot dist, filed at Gadag dist. Can it be entertained by Gadag court is my querry?

Hi,
I am sure lot of people/lawyers here know about MTECH developer/builder. They collected registration money for the properties in and around Gurgaon/Rajasthan but could not develop the properties and the money hasn't been refunded yet.
Lots of people might have filed suits against the builder. I am also one of those who registered in those properties but I am yet to file a case.
Before I file the case, I would like to know others' opinion. Is anyone here impacted also? Do you know anyone else who is fighting the case?
I am also looking for a good lawyer to file and fight my case in Delhi/New Delhi. Please contact me on my email.

An authority is not paying its staffs from last six months. Can the staffs ask the reason and when the due will be paid? Can the matter be related with life & liberty of the staffs?

please give me your valuable advice so that i can save a family.My uncle stays in UK. He married a girl who was also working in UK during 2007. Due to imcompatibility, the marriage broke down after A YEAR. NO ISSUES. They both started living separately. After some time, through her people, she collected all her belongings. At the time of taking away the belongings, her people assured that the girl herself has instructed to obtain her belongings since she wants separation and that they too are in favour of it and that they would not create any problem since they are keen for a peaceful settlement. The girl was kept informed of their assurance and also the fact of deliving all her belongings through e-mail and letters. She did not respond(but later in the complaint filed with the police she has confirmed the receipt of all her belongings). However, after collection of all her belongings, her people went back on their assurance and continued to dodge withy various demands. After waiting for a considerable time my uncle flew down to India in the beginng of 2009 and filed a divorce case. After a lapse of six months of the filing of the case by my uncle and after issue of the notice by the Court, the girl returned to India and hoisted two false cases against my uncle's family i.e. one under Prevention of Dowry Act and another under the DV Act, in DIFFERENT COURTS. The Court which is handling Dowry case has issued non-bailable warrant to my uncle. In the Court which is dealing with DV case, she is pressing for issue of direction to the Passport Authority to impound or cancel the passport of my uncle. In this background, I want your advice on the following points:
a) Can the Court give direction to the Passport Authority to impound or cancel the passport, particularly when my uncle is not in India and particularly when the alleged allegations are not yet proved by the court?
b) Since the cases filed by the girl are in the nature of counter-blast to the divorce application filed by my uncle and particularly when she has filed these two false cases after the issue of the notice to her under the divorce case, can my uncle challenge both the cases in the High Court?
Please enlighten my with your valuable advice, with case laws if any. You will be doing great service to the family in distress. Thanks.

In one matter, public trust is made defendent. As trust is not legal entity, it is necessary to add all trustees in the suit. Whether one can amend the suit and add all trustees as defendents ? whether limitation act will be applicable for amendment ? the suit was filed 3 years back. The suit is still not at hearing stage.

Respected sir,
I have filed a complaint with DCP Vigilance on 20-9-09 and copy to jt. CP and CP in connection with my personal grivences that IO has submitted the false, febricated and biased repot in the court. I asked for the department inquery as well as the transferred of the officer and requested that he should not be given any responsible job. When after a month , there was no reply to me complaint . I filed a RTI in this regards to DCP Vigilance on 21-10-09 along with the RTI fee. On 10-11-2009, DCP Vigilance told me that your RTI we have already forwarded to Addl. DCP, South-East to take the action and give the reply to me and it is for my information. As the replay was received from the ADDL. DCP south east , so i wrote an letter to him and copy to DCP Vgilance, jt. CP and CP also.on 25-11-2009, But even after that i have not got any reply of any of them. what further action is to be taken or shall i approach to CIC for not giving any reply to my rti. Request advice.

change name of minor
Sir,
i had named my baby boy in the birth certificate in Chandigarh. Now due to some problem I want to change the nae but the Chandigarh Birth & Death department says that I can not change the name of my minor son. Sir, please suggest me how can I change the name. Please tell me about the procedure and legal documents used and also their wordings.
