Sec 239 Cr. P. C.

In a criminal case the last three dates are being given for framing the charge. However either all the accused are not present or the Public Prosecutor is not present before the court. For this reason the court is not framing the charge.
Now next date is also for framing the charge.
At this stage can an application under section 239 Cr. P. C. be filed on behalf of one accused? there are 5 accused.

Amendment of MAT suit

Whether after filing a divorce (MAT) petition it can be amended ( the whole petition)? The suit is just filed and other party has been given notice. It is intended to amend the whole petition on the next date (that is the third date given by the court). Is it possible?
Please guide about the procedure. What should be the format of the amendment?
