Limitation Act

Limitation act will not apply to Usufructuary Mortgage. Mortgagor is entitled to redeem the property even after 30 years. Is that correct?

Limitations of Section 145 of CRPC

Sir,
I had bought a property in 1995 which later turned out to be disputed. Now, the other party has charged me with section 145 crpc. They have put in a case on 29/4/11 of an incident which occurred on 6/4/11. I received a letter on 23/7/11 about the following and that they SDM had called me on 25/7/11. Now, the SDM has decided the date of hearing to be 25/8/11. So what can be done till then? Is the section 145 valid for over 2 months? Or can I put a civil case so that the case of section 145 can be quashed? Please guide me about the same. I will be highly indebted.

Bancassurance Query

I had availed a bancassurance policy( mediclaim) in the year 2006. 3 years later the bank tied up with another insurance company to service the policy.
At the time we were given to understand that all terms and conditions would remain the same(acknowledged by email).
Repeated request to get a copy of the policy terms and conditions got the Insurance company to send me the terms and conditions, wherein there were a few new clauses favouring the Insurance Company.
( but we were given to understand that those clauses would not matter)

After holding the policy for 5 claim free years, when I last went to renew the policy I was told that the premiums were hiked and that my cover would be reduced.

In Effect my family floater policy( Parents+ Married couple)for 5 lacs was divided into 2 policies as such( parents 3 lacs+ self( married couple 3 lacs).
Premium was correspondingly reduced compared to earlier.
I was agreeable to a hike in the premium ( due my earlier folly of not qestioning the change in terms and conditions at the chnage on Insurance company)but needed the same Sum insured.
But the underwriting team at the insurers refused to give me the same benfit( and this after 5 claim free years).
What they would like me believe is that I am benefitting because of a 6 lac(3+3)policy as against a 5 lac policy initially.
Isn't the very purpose of a floater plan defeated here????????
Besides I was informed of the same( Lesser cover) verbally when I went to renew the policy at the Insurer's Office.I have no written letter intimating me of the change in policy procedure
I have this correspondence on email and now wish to proceed legally against the Insurer/ or bank whichever at fault here.
The grievance redressal forum at the Insurer's Office would also have me believe that I stand to gain by the new policy and are not willing to give me the same cover.
The bank staff is as usual -LOST and ask me to contact the Insurance Company.

Medical Insurance

Good day,

I have been recently operated upon due - Cystectomy and an endometriotic condition which was also causing an infertility issue as diagnosed during the pre-hospitalisation period.

I am medically covered through my employers for a S.I of INR 3 Lacs and my hospitalisation expenses was INR 98000.

My claim was recently refused sighting that the treatment was related to infertility.

I have a history of endometriosis and cysts and in the past have been operated upon once for the cystectomic condition while I was still single.

This time the cyst was detected earlier on during sonography and the endometriotic growth was also cause for concern.

The condition would anyway merit an operation. Is the insurance conmpany justified in refuting the claim just because it was done in connection with an infertile condition?????

CLAIM FOR INTEREST

Respected experts-
Suit on simple mortgage.Property mortgaged for Rs.3,00,000/-. Contract rate of interest is 24% p.a compound. suit filed by calculating compound interest. Interest comes to Rs.11,00,000/-. Nearly 3times of borrowed amount. Is there any relief available to defendant praying for reduction of interest amount OR HAVE TO PAY THE AGREED RATE OF INTEREST? ARE THERE ANY ENACTMENTS THAT CAN CAME TO RESCUE THE DEFENDANT? The transaction had taken place in the state of A.P.

Division of property

In order to get the property registered on the name of a person without any legal implications from any of the family members in any future course of time.whether partition deed or gift deed is suitable and any property devolved on a person as part of partition deed, such property can again be partitioned among his/her heirs?

Protection against Re-entry after execution.

My neighbour has a 30yrs old 5000sqft property in Bangalore. It was Litigated for 20+ years. He won the case in Court and Execution Orders are posted to be heard in 08/2011. it is felt that, after the execution, there will be a re-entry by the tenant as she is in 'contact' with a rowdy. What is the protection that one can expect from the Police. In general, is there any relief/provision available for an old(58) person???

temple marriage..hindu marriage Act

hello sir,I m hindu (female)and i got married soon on 26 june 2011 in a temple (maharastra/alandi)i have an issue dat my husband left me..he dont want to reside with me and his family is not accepting also ...but i have marriage certificate wid me which is provied by dat pandit and pandit have also marriage record of us. but there is no witness of our marriage accept dat pandit n few people around there .n i dont have any marriage pics also.me n my husband is in past 5 yrs relation also apart from this we have stayed in living relationship around 2 yrs in pune .but ritenw he dont want to live with me so i want to file case against him..

1.is it a legal marriage?
2.if yes then what cases i can impose on them?

please guide me..need help
