498a & 406

Sir,
3 PW cross examined till date in case for 498A & 406 filed to me by my ex-wife, in oral evidence they have said a lot of absurd like she was beaten, dowry & cash was demanded & I have even killed my first baby. They lady was thrown out of the house by her husband etc
But it is all oral the evidence, they do not have any proof of all this absurd like demand of cash or transfer to my any account, killing of baby, & even beating as their no certificate from any Medical officer.
So my submission what is the credibility of this oral evidence in a criminal case like 498A

Senior advocate/advocate on record

Is it okay to engage only advocate on record for Supreme Court civil appeal case or one should engage senior advocate also. Does court give more importance to senior advocate during arguments.

Legal heirs no objection affidavit is asked though regisered will is provided

My Uncle owned a plot in Pimpri Chinchwad New Town Development area(Pradhikaran), Pune.
He purchased the plot by hiw own earning. Before death, he made registered will and mentioned that after death the plot should be transfered to his eldest son in it.

Before a month, he got expired. When my cousin went to Pradhikaran Office to transfer property on his name with referance to registered will, Land Officer told him that in addition to registered will, they need No Objection Affidavit from all other Legal Heirs as per their procedure.

The problem here is other Legal Heirs refused to provide No Objection Affidavit. We know that they will not challenge Will in court as it is genuine and the property was purchased by uncle with his earning. However they are not co operating us.

Is there any way out here? Please help.

Nego. 138

Pls ans..
If A advances sum of money to B on B's promise to get job in a Bank and later on B says that he was not the authority to give job and also denies to give money back to A. B also, by way of agreement in favour of A, duly notarised, conveys A that from very initial stage, he has cheated A and gives a cheque of the amount lent by A to B and mentions that cheque-details in that agreement and promised A that this cheque will be honoured on presentation in the Bank and if not so, then A would be free to take actions against B by Nego 138 and IPC 406, 420 etc., but the same is dishonoured. After dishonour of cheque, demand notice was also duly served. Whether the complaint u/s. 138 against B is tenable??
