Dear Learned Experts,
Kindly advise me on the below given issue.
One company wants to transfer an immovable property to another company in the same group. The immovable property is an office premises on a building which is governed by a society.
Bothe the companies are part of a same group of companies. The directors of both the companies are also the same.
As per my understanding, the immovable property can be transferred vide an agreement by paying applicable stamp duty on current market value of the property.
My question is, is there any other way to transfer the said immovable property without executing a sale deed or conveyance deed?? If yes, can the society play any role in such kind of transfer?? Is the stamp duty applicable when both the companies are of the same group with same board of directors??
Kindly advise.

Hi, I need expert opinion on following situation arrived to my Jijaji
He was staying in lalbaug of Mumbai which is taken over by MHADA under Maharashtra Building Repairs & Reconstruction Board (MBR&RB) and developed by private builder
Original room agreement was on my jijaji’s father and jijaji’s name
But after death of my jijaji’s father (2 years back), jijaji’s elder brother has managed builder to include his name by showcasing notary will (not registered) of my jijaaji’s father stating 50-50 ownership of both brothers on all his belongings
My jijaji’s brother is staying in his own house in other suburb of Mumbai from last 15 years
Last week builder has given possession (keys with possession letter) to all owners but refused to give keys to my Jijaji
Builder is saying that, as per MHADA rule, without presence of jijaji’s elder brother he won’t give keys
Whereas, in spite of many request, Jijaji’s brother is not coming forward to take possession and forcing my jijaji to sell flat and give him 50% amount
Now situation is that, my jijaji don’t want to sell flat because it will be very difficult for him to buy another flat in the 50% money and since Jijaji’s brother is not coming forward builder is not issuing keys (not even 1 set of keys)
My jijaji is currently staying in rented house which he has to vacant in next 3 days
1) Please help me out with your suggestion that how we can get possession?
2) Is it really a MHADA rule that all co-owners should be present to get keys?
3) If yes then what is solution to get possession?
Please help!

hello,
i was a pilot (in capacity of a VP)with a reputed company in nagpur with its head office in nagpur and registered office in kolkatta. This company did not pay wages for 09 months. i finally left the company with a notice for non payment. other defaults are non payment of IT deducted form salary for 18 mths and non deposit of EPF for the period salary not paid.
my querries are as follows:
1. can i file a criminal complaint with police for EPF. i have already approached EPFO nagpur, however that has only resulted in the company depositing EPF for the month the salary was credited (one year late)
2. what process should i follow on IT dues as that has made me a tax offender.
3. If i want to proceed with winding up petition, then can it be filed in nagpur or only in kolkatta in my case.

My wife filed case of CrPc 125 for maintenance of self, and two children in Ahmedabad family court in December 2012. The court did not gave any interim order. Now in May 2014 the court gave final order and rejected wife's application for maintenance but ordered for two children. The court has order for Rs.5000/- for daughter and Rs. 4000/- for son and both of them are minor. I am drawing salary of Rs. 12,000/- per month currently.
My question :
Whether this maintenance is applicable from the date of application or from date of order.
If it is from the date of application, should I have to pay for the last two years maintenance. If it is tru how can I pay around Rs. 2.00 lakhs @ Rs. 9000/- pm maintenance.
Can I appeal in High Court for reducing the amount of maintenance.
I am not in a position to pay Rs. 2.00 lakh, what action the court will take.
Please help me.
Thnx

The flat originally was purchased by the father and inherited by the mother after his death.A Will made by the mother in Andhra pradesh and registered there.Mother had in her will given the property - a flat in Mumbai to her son.The property in question is a flat in a society. There is a claim from the sister for the flat eventhough the mother had given 100% share to the son.Mother had given in her will certain amount by way of FD for her daughter.can the daughter claim the share in the property also. The mother had settled her claim through her will by giving her Fixed deposit with a bank.Should the society transfer the flat to the son based on the will or ask for the probate of the will
ADVICE PLEASE
A lent 5,00,000/- to B on 1-7-2013. Got promissory note dated 1-7-2013. And obtained a post dated cheque with 25-10-2013 which was bounced for insufficient funds. Case filed against B. The counsel for A, in his plaint stated that B approached A on 5-8.2013 for loan and obtained loan on 10-08-2013. And given a promissory note on the same day. And stated in the list of documents , original promissory note dated 10-08-2013, which is actually with the date 1-7-2013 ( there is no promissory note with date 10-08-2013). In the marked exhibits, it is mentioned as original promissory note dated 10-08-2013. And in the judgment also, in the list of documents, contains original promissory note dated 10-08-2013.
The judgment is delivered against the complainant stating that loan was asked on 05-08-2013, and amount is given on 10-08-2013. How the promissory note will be anti dated i.e. 1-07-2013. Hence no transaction has taken place on 10-08-2013.Case decided against complainant.
The complainant caused a heavy loss due to the negligence of counsel. Please suggest the grounds for appeal. Is there any provision to lodge a complaint against the counsel for negligence.

Non deposit of epf by employer
Dear Sir,
my employer has not deposited EPF for 09 months before i left the company due to non-payment of wages for similar period. druing the period of non deposit of EPF, salary was not paid, however, some advances were given (in lieu of salary - no documentary evidence to that. However, i have salary slips (duly signed by VP HR) for the first 04 months out of 09 months no salary given.
I have met Reg Commissioner EPFO, who says that since no salary was dimebursed, no criminal complaint arises.
kindly advise if i can file an FIR for the same. as this can also help me in recovering some salary maybe.
