Can i ask for court fee refund in summary suit?
what is the substantial process for that?

I am residing in mumbai pagdi type building this building are 60 years old & 27 tenants in building structure are ground plus 2 floor. 8 tenants are residence& 19 tenants are commercial (made by landlord). That time building are very poor condition In so all tenants are thing & ready to repair but landlord are not ready to give permission for repair and b.m.c are also not given us that . my query are this.
1) My room are rent recipt name in my mother and she is dead sines 1999 and my father also daed sinev2005 and I resding here from my berth. I regular paying rent .
2) If that buliding are demolies by b.m.c. or collieps than my I got my mother room ?

So plz your best advice gives us.it is very urgent case .

Court fee refund

i filed summary suit for the recovery of money about Rs 1 cr in that the court fee was about 3 lakhs
my question is weather i can ask for refund of that Rs 3 lakhs which was the court fee?

Hello,

Two brothers A and B got a probate order from the court which stated that the petitioners are entitled to Letter of Administration in respect of Will with subject to petitioners furnishing the following -
Estate Duty clearance
Valuation Report
Requisite Court Fees
Administration Bond and
One Surety."

The list of properties given at the time of Letter of Administration/ to the court contained four immovable properties some bank accounts and one bank loan.

A and B did not fulfill any of the above said conditions laid down by the court regarding the Letter of Admin.

A without the permission of B sold of one property.

My queries are -

As the rights of the properties are entitled to A and B only after the conditions of the probate order are fulfilled as stated above, what will be the status of the sale of the property by A .

a)Will it be an invalid or void transaction if challenged by B in the court. .
b) Can a case be filed for the cancellation of the sale deed by B.
c)Does the buyer of the property has any remedy to save the sale of the property.
d)Is the probate order still valid and can it come into force after the conditions laid down in the order be fulfilled.
e)Can the legal heirs of B approach the court for the fulfillment of the conditions when both the A and B have expired.
d)Can the legal heirs of A also approach the court.
e)Can the buyer of the property also approach the court and has any remedies

File a suit in labour court

Dear Experts,
I was searching work in Mumbai but not having enough money to survive so I joined a security guard agency as watchman. I joined it on 4-03-2014. When I asked for payment, he started prevarication. At the time of joining he said to give 7000/mth for single duty and 12000/mth for double duty but later he said to pay 5000/mth 12hrs and 11000 for 24hrs. I asked him many times but always he said to come on next day and next day, he said to come next day. On 23-05-2014, I again asked for salary but he didn't give and dis-employed me and ask to come on 26-05-2014. I again went to him but he denied to pay and threatened. He said don't show me your face again. Then I went to police station, they told they can't do anything and said to go to the labour court. When I pressured then they registered NC. As you know that 'Security Guard' comes in 'unorganized' employment. I performed 87 duties (day and night). Owner of the company says that I don't have any proof about working in his agency. Yesterday I went to 'Central Government Industrial Tribunal-cum-Labour Court-MUMBAI', an official asked me to go to state label.
Can you please suggest me, what should I do? Can you tell me what is the govt. rate for watchman as per constitution. I want to file a harassment case for compensation also. His company seems illegal and violating human rights. If there is any NGO or any other organisation, working in Unorganized field or Labour Matters and Human Rights please suggest..

Mr. R died without leaving a will. He is survived by his wife, two sons and a daughter. Mr. R had a house in a plot of 4 grounds (approx. measuring 3900 sq. feet). After his death the house was demolished as it was very old and not fit to live. The plot was divided in 4 parts and each of the surviving member got 1/4th share.
Mr. R’s wife and 2nd son relinquished their respective share in favour of elder son during their life time through a settlement deed mentioning that under any circumstances they will not claim their shares (Deed is duly registered). A new house was constructed in 3 parts of the plot by Mr. R’s elder son with his self earned money. (leaving 1/4th part of Mr. R’s daughter) An affidavit is given by the sister (Mr. R’s daughter) saying that she will have no claim in the house constructed by Mr. R’s elder son (Affidavit is registered).
Mr. R’s daughter is a co-owner of the said plot for her 1/4th share. The Mother is getting a widow pension of about 13000/- per month. Mother was being looked after by the elder son for the last 35 years.Mr. R’s elder son died without leaving a will and is survived by his mother (Mr. R’s wife), wife and a son.
Question is based on the above given facts:
Who would be the successor to the house. Would it be the mother, wife and son or only the wife and the son? If mother is also a successor how much share she would get. If the mother gets a share, can the younger brother and sisteralso can claim a share from that portion?
