Lic policy

A senior citizen X had made a LIC policy in the name of his children so that when they grow up and the policy matures the children will get the money.

But the children are not looking after the senior citizen and hence he does not want to give the money to them. When contacted LIC they told him that after maturity the money will go to children only.

What can be done in such a case? Cant he reclaim his money?

Professional tax deducted but not deposited by company

I was working in a delhi base company in their Bihar road project. This company deducted our Professional tax but not deposited. they don't have an account also and not interested to open account. they are working in the state for long time but not depositing professional tax. this is a crime to the nation. i want send this massage to Bihar Professional Tax department with proper procedure so that company should not escape by paying to some tax department officer. please guide me on this issue.

Can named (prospective) accused represent himself or through any lawyer

My basic question is that after filing of FR that there is no offence, at the time of considering this report i.e. at the time of taking cognizance/closing the complaint at the magistrate level, can named (prospective) accused represent himself or through any lawyer, because it is he who is going to suffer the agony of trial if cognizance is taken due to negligence at the level of Magistrate sir, or govt. lawyer i.e. some decided legal decisions are not brought to the notice of Magistrate sir. So please guide whether at the time of considering this report by the Magistrate Sir, the named accused can represent himself or through lawyer.

Remuneration of partners

AS per section 40(B) of income tax act minimum remuneration to be paid to partners is 90% of book profit or 150000 on initial 300000 rs. w.e. is more. If return of the firm is to be filled under section 44 AD and the profit comes to say rs. 95000. and suppose remuneration paid to the partners is rs. 80000 what will be the effect in firm's return and individual return?

This is Vinod from Bangalore. I had seen one property in Bangalore which comes under BBMP limit. Not sure it's A khata or B khata.
Builder is saying it's A khata.

Building contains only 8 flats and there are 4 partners for that Building . All the houses were sold out and only one is left out. People are staying from past 3 to 4 years in other houses.

1) When I checked with the builder regarding OC, he said we don't have it now. He said we can get it . How much money is needs to be paid for BBMP to issue the certificate ?

2) Is there any penalty needs to be paid for BBMP, because the building got completed in 2010 or 2011. Until now he haven't got the OC ?

3) What are the documents that I need to ask for a builder for a lawyer verification ?

What is the maximum time limit that i can go for appeal in high court.

My wife filed 498 a and DVC against me and that was still pending with court. I had applied for divorce and that was canceled in the lower court.

I want to go for appeal in High court by taking orders from lower court. Can you please tell me the maximum time limit that I have to go for appeal without any justifications.

Please tell me the process to apply.

Exemption from personal attendance of accused

Is the benefit under section 205, 273, 317 available in criminal appeal. Any citation of recent past inn favor of the applicability. Out of 12 accused only 1 will appear an others like to appear through pleader. the case is in appeal stage.

Twoo suits filed in 2 different courts for same matter

Respected Sirs,

I M the Landlord of a property in Mumbai. I have filed a eviction suit against my Tenant for illegal additions and alterations carried out by him. This suit is filed in Small causes Court and the matter is about to come up for my cross.

The Tenant has filed a suit against BMC in City Civil Court as BMC has issued MRTP notice against the Tenant for illegal additions/alterations carried out by him. The tenant had not made me a party to the suit. However the Civil court and Bombay High court have passed orders that the Landlord is the necessary party to the suit.

Both the suits are for the same matter wherein in the first suit the Landlord is Plaintiff and Tenant is defendant and in the second suit the Landlord along with BMC, and state of Maharashtra is defendant and Tenant is Plaintiff.

My Question is can 2 suits of same nature be contested in 2 courts or which suit can the Landlord press for dismisal because the arguments, the cross , the evidence would be the same in both the suits.

Please give your valuable advice.
