Gratuity

Respected sir/madam,I am prakash sathvara, i had work 4 years 356 days only 9 days less in 5 years in UPL LIMITED COMPANY, BHARUCH(GUJARAT) without any break.i resign in that company with one month notice period completes 4years 356 days. MY company didn't gave my gratuity.SO, by indian labour&service law, can i have my gratuity or not?

About sale deeds

Few months ago I got a plot booked in my name. The booking form and agreement mentioned only my name as the buyer. Now after having paid the entire amount for the plot I want a registered sale deed to be executed. But to save cost(stamp duty) I want that the sale deed mention my sister, and not me as the buyer and be registered in her name. Is this possible, given that the earlier agreement did not mention her name as the buyer ( or allottee )

Judis - not able to find records other than case status (disposed)

Hi! All,

I was able to search status of a case pertaining to my late father in http://courtnic.nic.in/courtnicsc.asp and the case status says "disposed" with "diposed date" as 21/03/2007 but I am not able to figure out what was the end result? Was there a decision/conclusion?If so how can I find out the same as I can't find any other record in Judis. I tried all possible combination of searches (with case number shown in case status record, with daily judgements around March 2007 etc.)

Any guidance will be highly appreciated

Cheated by a man

Hello sir, I am keen to know if I am eligible to file a law suit against a man who has cheated me not once but twice in a same way . The background is 4 years back , I was in a so called relationship with a guy who was my senior in university. He behaved like his feelings were genuine and almost raped me, used me physically and dumped me sayin he is not serious about this relationship. Later on he moved on for his further studies and my parents got married to someone and I moved to Australia. After one year I separated from my husband on domestic violence grounds. After a few months , my so called ex boy friend got in touch wit me again and I was a fool enough to assume he had realised his mistake so he is back. Also when I shared the news about my separation he felt sorry but started flirtin after a few days and this kept on going for about 6 months. While I was in a hope of getting back to him again as I loved him truly he plotted to use me once again. I travelled all the way back to jndiA spendin my money , treated him in a 7 star hotel, got him expensive gifts... He again used me physically and later when I questioned him about his intentions of getting back to me he states that he wants to be good friends with me as I have a nice heart. He again deceived me. He keeps in touch with me but has no feelings what so ever . I have a proof of his almost naked pics he used to send me and also the proof of hotel room I booked . The hotel had collected both our ID cards and I am sure they have records of it. Is there any sort of cheating case I can file on this man for harassing me mentally and cheating me with his wrong intentions. Please help me

Demanding more money than actual due

Dear Expert,

Please advise on following matter,
Mr.X had account with Co-op Bank for personal loan against security of plot of land,After demise of account holder, bank has served notice on legal heirs for loan obligation, Legal heirs proposed to sell the land, Loan amount was 40 lakh and Valuation report then submitted showed value of land as 55L.
Now account is NPA , Legal heirs do not getting any buyer above 40L , also Government valuation of plot is only 20L , Bank obligated to sell it for 55L (as per valuation report submitted) Which is not at all possible. Deal may settle at 40L only.
1] What is the legal course of action that legal heirs can opt.?
2] Is bank's contention stands valid ?
3] Is bank obligated to take fresh valuation report periodically to verify the actual value? Can bank demand more money than actual due ?
4] What if legal heirs paid only the amount which was due ?

Christian widow residing in mother-in-law's property: can this be partitioned

A Christian Widow resides in her Mother-in-Law's house with her 2 daughters.

Now her Husband's only Sister is seeking partition in this house

Mother-in-Law expired in 2000
Husband expired in 2013

The widow's only source of income is the rent from the portion of the house let out to tenants. Will this house be partitioned as per Christian Succession Act.

Refund of money on cancellation of deed

Dear All

I hv made a deal of Rs.53.75 Lacs for purchase of residential property & out of 53.75 Lacs i hv paid in black Rs.12.75 Lacs & 40 lacs white .out of 40 Lacs i hv applied for Housing loan of Rs.35.00 Lacs now i want to cancel the deal & the seller has informed me that i will get the refund only after selling flat to other party & pl.note that whenever i hv paid black money i hv obtained signature on revenue stamp now pl.advise me how to get speedy refund from my seller pl.help

Remarriage

Hi Learned Members,

Happy to share the case has been disposed and the divorce decree has been passed under sec 13 B HMA.

Thank you for all the members in this forum who have assisted me in coming out of this cliché.

I wanted to know if there is any appeal clause under 13 B HMA for remarriage?

I have heard 2 statements:

1. One has to wait for 90 days for either parties to appeal for set aside the decree

AND

2. Under MCD there is no appeal clause one can marry immediately?

Could you please let me which is correct?
