Compassionate appointmnet

Sir,

My father expired in the year 2000.he was in one of the PSB. My mother applied for the compassionate appointment in the same year but got a reply from the bank saying that our financial condition was good enough to survive without a job(no one came for inspection and obviously our condition was not good enough.)my grandmother's medical condition was not good.We had a lot of medical expense on her that time.I and my brother were also below 18 years.neither we were given any such amount as compensation,so after trying much on our level we filled a case on bank in 2004.we were also told that appointment on such basis was discontinued that time.(however, through RTI we got a list of more than hundred such appointments in that period.)the case is still pending in the court at present.now we came to know about a notification saying that appointment on compassionate ground has been started again.I want to know will we be getting benefit of this notification in our case?and if no where are we lacking in our case?

Recall & set aside exparte order

Sir

The wife filed a 125 Cr.P.C. case against husband in Visakhapatnam Dist

Husband filed Conjugal Rights for his wife at Srikakulam Dist

wife filed a transfer petition before A.P. High Court it was transfer to Visakhapatnam

At this juncture husband given vakalat to his counsel i.e., Section 13 of Family Court Act "permitting the counsel on behalf of him to represent before the Court"

Good or bad : His counsel not appeared/represented before the Court

The maintenance case is exparte order passed based on Vacant land "

Perused Chief Affidavit and Ex –A-1 sale deed in favour of respondent satisfied thus the respondent is earning more than Rs.12,000/- to 13,000/- per month but avoiding maintenance. Petition allowed directed respondent to pay Rs.2,500/- per month to the 1st petitioner and Rs.1,000/- per month to the 2nd petitioner from the date of petition on after deducting payment made if any during pendency of the case.

How the Officer passed this order for an vacant land generates the income :

As well as due to no representation the Conjugal Rights case dismissed for default

NOW I AM FILING A PETITION WITH SECTION 5 OF LIMITATION ACT AND ORDER 9 RULE 9 OF C.P.C. FOR Conjugal Rights CASE

WITH A MALA-FIDE INTENTION WIFE FILED EXECUTION PETITION OBTAINED N.B.W.

NOW IN SIMILAR FASHION A RECALL PETITION IN MAINTENANCE CASE IS FILED: under section 70(2) of Cr.P.C.

a medical case file available

what are grounds to be taken to recall the warrant & to get set aside of dismiss for default order

kindly guide with citations

Registration procedure for gpa property.

Hi,
My parents are jointly holding a GPA property which was made in the year 1990.
My father expired 10years back, and now we actually wanted to register the GPA property to my name and my sisters(Jointly).
The principle owner of the property who gave GPA to my parents is Alive.
Please give me some idea on how to get registered the property as mentioned earlier.
Regards,
Prem

Guidance

I have bought an old residential property measuring 815 sqft which has a return frontage out of original property of size 15 x 70 feet = 1,050 sqft. in 2014. My property entry side has about 15 x 55 feet and a private passage of size 3.75 x 17 feet to main Bazar.
In 2007, My vendor has conveyed 11 x 17 feet which is 187 sqft in Bazar Side as a vacant land, which was again conveyed to another person in 2008 as vacant plot. The new purchaser has constructed a G+1 Shop, encroaching 1.5 x 17 feet from my common passage. Conveyed Commercial site boundaries are clearly mentioned where western boundary is a common wall. Record is there for western boundary which is half foot belonging to either parties. While purchasing the property we have protested the vendor regarding discrepancy for which the vendor said this was a clear encroachment and informed and protested verbally and in our title the passage is 3.75 x 17 feet whereas now we have only 2.25 x 17 feet. Now we are constructing new residential building and settled common wall with major western and eastern neighbors in writing. This southern neighbor we have agreed to pay the common wall expenses who has permitted to roof concrete which is touching 11 feet in the south side and 17 feet on the west side. Is there any way to reclaim our 1.5 feet x 17 feet encroached land by the shop owner?

Advance thanks. Kindly guide us experts.
