Compensatory off

Dear Sir,

I am working for IIM as an Office Assistant. Many a times I have to work on Saturday and Sunday. On claiming Compensatory off, our CAO says, there is no rule for the same. Also , we do not have a framed HR Policy as the same is under process of framing. I also referred Swamy's Hand book where I could not found any clarity regarding the same.

Request you to kindly help me in this regards as do we have any rule in central government for availing Compensatory Offs at Office Assistant And Administrative Officer Grade.

As per the Companies Act 2013, I want to know whether an individual can be appointed as a WHOLETIME DIRECTOR of two Private Limited Companies.

Which section of Companies Act 2013, is applicable in this regard.

resignation in probation

Dear experts,

If some one have to resign from the post of clerk in govt bank in probation period.. the probation period is 6 months in clericle cadre..and there is no bond or any kind of signed agreement...does he have to pay anythng to bank if he regins..

Purchased assigned land in 1981 - reg

Respected Sir,

This is Samba Murthy Madeti, from Visakhapatnam and I would like to have an advise on this.

My Grand Mother had purchased a land in 1981 and later she realised it as Assigned land. Infact she is really unaware of the fact that the land is assigned land. However, she got the land registered in 1981 and also got a passbook. Later she was not allowed to enter the land and she protested it and were in the possession of land. We did not pay any taxes as we were afraid on what can happen further.

We did not make any developments there but were regularly checking the land. Area slowly developed and my father and his brothers settled in various locations by virtue of Job. We neglected the land since 1990's.

Now we went back to see that government boards were placed in our land. We were surprised and for our surprise the land was unrecogised due to huge development in that area. However we were able to locate the land from unofficial sources and found the land to be in existance.

We file for status quo and go status quo from High Court of Andhra Pradesh. We applied for Survey and the local govt people are not helping us officially even after we paid the fee and required amounts. We went to High Court for Survey also.

However, I am writing this to understand the legality of my land. I am ready to pay all the expenses I need to pay to government to regularise it. Can any of you help me in providing case laws and references in which such lands are regularised? Apart, please do suggest me on how can this be regularised with out any hurdle.

Long term capital gain tax

I have incurred long term capital gain tax on sale of my property. I am planning to save this tax by using that amount in different instruments. My query is: Is it possible to invest part amount in tax savings bond (like NHAI) and rest depositing in Capital Gain Accounts Scheme for future purchase of property?

Plz urgent help me - my registration can get cancel

Dear Sir

I am posting the same query again with in 24 hrs as my earlier query did not got any reply.

PLZ REPLY.

I have got a house loan from a bank and registered a property by calling commision .
The property was already running on loan from the same bank . So , there is case of book adjustment also from the bank on the seller account .
I have paid the registration charges and stamp duty . The TDS is also paid . My contribution of 20 % by demand draft is also paid by me . I have also paid the 3.09% service tax to developer , as the seller has not registered the property before .
I also have a possesion certificate from a developer .

The registration was done by calling commision and bank has given a xerox of check to seller and asked him after getting the IGR from registered office , to take the physical delivery of check .

Deed mentions about a book adjustment value , check number and my contribution draft details .

Now , today when the seller went to Registration office for IGR , it was not provided as the registration office told him that , the extra 1.1% of stamp duty have to be paid as the property was not registered before and then only IGR will be provided .

The seller and bank is asking me to pay this amount otherwise registration will get cancel , as book adjustment will change.

Kindly advice , is it possible that registration to get cancel and my money getting stuck by no fault of mine .
They are forcing me for 1.1% but I dont want to pay .
I need urgent advice . PLZZZZZ

Lokadalat

I went to LokAdalat, the Bank said one time settlement amount and I agreed and I had ask only 6 months time, finally they agree and the agreement prepared by the Hon.Retd.Judges Desk and I have signed and I ask the the copy of that they advice this is not necessary for you, the Bank will sent you a detailed letter.
Now I am feeling very much I can negotiate the amount but I didnt. later I noticed other customers are negotiated the amount and they settled.
Now I have any chance to negotiate.
Please advice.

Claim for permanent desability

A 9 years old boy belongs to barber community. His father is a Shrilankan refugee. Mother is Indian. 1 year before he lost all of his right leg fingers while going to school in bike with his father. No complaint/FIR filed.
1. What are the reliefs available for this boy?
2. Weather any ministry is there for scholarship?
3. What is the disability percentage for this boy?
4. Whether any free medical aid is available for plastic surgery?

Child custody jurisdiction

Please suggest me what to be done in this case. Any good citation would be really helpful?
I am physically challanged with 100% of disability. My both legs were afftected by polio at my chilhood. I Cannot walk. Working as Teacher (Govt. employee). I married one lady in 1998. A boy was born in 1999 Divorced in 2004. The boy's custody forever with mother. But she expired in 2005. The boy is living with mother's parental family, with the brother of his mother. That my son was adopted by him.
I married another lady in 2005 according to Hindu customs and rites. Got a male child on 13-09-2005. And a female child on 27-08-2007. She converted into Christian religion in 2002 (Took Baptism - I have got her baptism certificate ). She committed for criminal activities towards me and my father. She punished by the court u/s 323 and 506 of I.P.C. She also beat young aged children where medical treatment was given (prescriptions available). My wife discontinued 10th class. I encouraged her to continued studies, joined in B.A. open university. But she failed to continue it. She developed extra marital relationship with one guy at where we lived. And she left my society on 14.04.2013 along with female child where a missing complaint was filed. Our male child was staying with me. After 3 months she came to me along with the female child and stayed for 20 days and went away along with the two children on dt. 25-07-2013. At the time they were studying in private school under my custody. I called her to come back. But she did not heed. I used to send articles, dress to children. My wife filed maintenance case u/s 125 Cr.P.C. where she is residing. I filed O.P. seeking Restitution of conjugal Rights But she remained absent after counseling made. Ex-parte decree passed in favor me. And the M.C. case was transferred to my place on the ground of my disability. I am paying the children school fee upon the request of the school management (Through phone call) as the mother not paying. The male child is in 10th year studying 4th class. The female child is in 8th year studying 2nd class. The children may like to continue with their mother as they are residing with her now. The female child told me over the phone that she is afraid of her mother. My wife also wrote me a letter stating that she is working as tailor at her place She joined children in a corporate school. She is residing in her parental house though I called her to come back. She is getting trouble to pay children school fee which are heavy. Requested me to send school fee. And she also wrote me if I pay school fee she can withdraw the M.C.. I already sent the school fee and continuing. I wrote two letters with calling her to my conjugal society otherwise send the children to me in view of welfare and future of children. Which were not replied till now. Last letter to her by me on dt. 16th Novemer, 2014.
Me and my father are very much interested towards the children. As they are very attached us.
The male child born in the place where they are residing now. And the female born at my place. They stayed with me upto July, 2013.

Now my questions are:-

1. I would like to file custody petition. Where should I file? Either in my living pass – RCR decreed, The children grew here
2. or the place of residence of children right now. – The male child born there and they are residing there from July, 2013 continuously – Studying there.
3. What is jurisdiction point to file child custody petition?
4. Is there any possibility to execution RCR decree. And what is the procedure?
5. Am I eligible to get child custody?
6. Is she eligible to get maintenance after RCR decree passed in favour of me. (Ex-parted)
7. What is the time limit to re-open the RCR set a side by her?
8. She ready to give divorce. I am not interested to leave the children with her. And I think she may change.
Seeking your valuable opinion on these points. Kindly reply as soon as possible.
