MYSELF AND MY YOUNGER BROTHER SHARING OUR MOTHER'S PROPERTY WHICH HAS BEEN REGISTERED WITH SETTLEMENT DEED. GROUND FLOOR IS MINE AND FIRST FLOOR IS MY BROTHER'S. NOW WE ARE NOT IN GOOD TERMS AFTER OUR MOTHER'S DEATH LAST YEAR. SO CAN I SELL MY SHARE OF PROPERTY (GROUND FLOOR) TO A THIRD PERSON? OR CAN GET LOAN BY HYPOTHECATING MY SHARE?
PLEASE ADVICE ME.

WE THREE BROTHERS BOOKED 3 INDEPENDENT FLATS AT RAJ NAGAR EXTENSION IN 2011 AND PAID 95% ADVANCE FOR EACH FLAT APPROX RS. 25 LACS ON EACH FLAT HAS BEEN PAID. THUS ABOUT 75 LACS HAS BEEN PAID FOR ALL THREE FLATS.
POCESSION OF THE ONE FLAT WAS DUE IN JUNE 2012 AND FOR REMAINING TWO WAS IN JUNE 2013.
POCESSION OF ONE FLAT WHICH WAS DUE IN 2012 HAS GIVEN BY THE BUILDER IN DECEMBER 2014 AND CAHRGED PENALTY ON DELAY IN PAYMENT @ 18% AND HAS GIVEN PENALTY @5 PER SQ. FEET ON DELAY OF THE POCESSION OF THE FLAT WHICH IS MENTIONED IN THE AGREEMENT.
POCESSION OF ANOTHER TWO FLAT HAS NOT YET BEEN GIVEN BY THE BUILDER.
CAN I CHARGE PENALTY @ 18% ON DELAY OF THE POCESSION OF THE FLAT WHILE IN AGREEMTN/APPLICATION RS. 5 PER SQ FT IS MENTINED.
ON ANOTHER TWO FLATS CAN I FILE CONSUMER CONSUMER COMPLAINT AFTER TAKING THE POCESSION OR SHOULD I FILE THE COMPLAINT BEFORE TAKING THE POCESSION.

A pagdi room is under the dispute between 2 brothers and their father is now dead (under his name is the rent receipt). The brothers are now ready to settle the dispute among themselves but the landlord is now asking for 5 lakh to transfer the name on rent receipt to one of the brother. Is it legal?

Dear Sir,
Plinth of my house is about 6" above the present road level of the street. Municipal Board is planning to rebuilt the road by raising its level by 24'' or more resulting the plinth level of our houses become lower than that of road. Can anybody guide us about the following;
1.If there is any law which governs the road levels in India?
2.Can we prevent local body or other construction agency to raise the level of roads?
3.How can we force them to maintain the level of new road as it was earlier?

One of our member has bought a part of the neighbouring / adjacent flat ( living room ) in 1985 . He then obtained a letter form BMC to allow him to close door of adjacent flat and open the door from his living room to living room of neighbouring flat. This letter says the permission is given without prejudice. However there is no permission from society and he has not submitted the modified building plan duly prepared by panel architect and approved by BMC. He however broke the part of the wall between two living rooms which is bigger than the normal door . He is asking society to regularise this merger . Society is insisting on the approved modified plan from him and he is not submitting the same . He has made a complaint to collector of Mumbai saying by not allowing him the total area we are harassing him . How the society can give approval without the proper paperwork . Please advise whether society is right in asking approved modified building plan showing the merger before taking decision of approving the new area inclusive of the part of neighbouring flat .

My brother’s wife lodge a FIR on 06-05-2015 u/s 498A, 406, 323,506 against my brother & parents and in response to this we have filled the anticipatory bail application to session court in which my parents got the same but we have moved to high court for brother.
Before lodged of FIR, we have already filled the divorce case in March’15 at session court and habeas corpus at high court against sub-inspector at woman cell who were forcefully took the children.
JFYR, my brother’s wife had left home in jan’15 and living behind two children but they tool forcefully in April’15 against which we have filled habeas corpus.
Now, I have following question :
• My brother’s wife suffering from schizophrenia (Mental Problem before marriage)
• Is my brother will get the anticipatory bail from high court.
. what is the procedure after getting the AB. will IO call us or we have to go to Police station.

i want to start a bussiness in rajasthan. my plan is that to supply prscribed medicine to patient at their home by collecting order from them by whatsapp,phone and msg. and also i will keep there priscription to me for record.i will open a medical store in my city also i will give bill to patient.
so my question is that is it possible or not in rajasthan.is there any law for home delivery medicine.

Claim money in the court given to relative
Hi,
My father gave Rs 8 lakh in 2013 to his sister's husband to buy a house on the condition of returning it back. Now my father is no more, the relative is not ready to give money back. The only proof is bank's a/c statement mentioning amount credited to relative's account by cheque. Can I claim the money in court & how?
Please advice. Thank you.
