Application from higher post to lower post

I joined a state university of the Delhi Government in 2019 as an associate professor. In the year 2022, I got a promotion to a higher post as a professor. However, I am still not confirmed against my initial appointment as an associate professor in 2019.

Now I want to apply for the post of associate professor at a lower level (in terms of salary and designation) at some other state University outside Delhi. The whole intent is to move close to my hometown. The question is can I apply through the proper channel? If I can't is there any escape route?

Perjury in court

Dear experts,
In a case involving my family property, the opposite party secured favorable judgement by submitting false affidavits and claims. We couldn't prove it otherwise as we couldn't find evidence to counter it. After judgement, we found ample and solid evidence to counter all their lies and to prove that judgement was obtained on basis of lies in court.
What are our options to get the judgement reconsidered and/or to file perjury against the opposite party.
Regards
Vinay Gupta

Caveat necessary after order?

Dear experts,

I have been fighting for custody of my child for four years in family court and recently won the child custody order in family court in my favour. Child is still with the mother and she was given two months to comply with the order of the family court and handover the child to me. I am sure that she will appeal the decision in high court.

I am in a dilemma and seeking your expert opinion. Some LLB holders (not advocates) have stressed that filing a caveat petition in high court is mandatory for me, because in its absence, high court might almost automatically grant a stay order against the lower court order (in this case, family court). Some others (advocate clerks) told me that filing caveat surely prevents adverse decision against me that would otherwise be given without notice to me, but the adverse decisions are based only on the merits of the appeal and not automatic. Further, that I would always be given the chance to give my version to vacate any stay orders. So, in their opinion, filing caveat is not necessary.

Requesting you to share your valuable advise in this regard. Please note that I do not have an advocate. I have represented the case in family court by myself all these years. I don't plan on having an advocate for the caveat or in high court for the appeal either.

Thank you very much,
Venkat

Contract labour leave encashment rules

There is a govt. security press in Nashik which is central, PSU. We have encashment semi-skilled and un-skilled workers from a conservancy service. Now, contractor is saying that since workers are entitled to 15 days CL and they have not claim their leaves so they are entitled to encash their leaves and if you are ready to reimburse the same then we will raise invoice. I need to ask whether contract workers are entitled to encash CL since nothing is written as such in the agreement. Plz guide.

Forcible acts of endowment employees and crooked archaka

A man krishna rao running small shop since 50 years, adjacent to satyanarayana swami temple compound wall, which has been let to him by one Gorongo Goudo and said goudo was died 30 years back.  None of the archaka has absolute right and title over the temple, cases run between archaks confirmed the same, lower and senior division courts dismissed their suits stating they do not have any right.  Even said temple is not under Endowment Department. One archaka srinivas with crooked mentality colluded with staff of Endowments department, trying to demolish shop of petty vendor Krishna Rao by forcibly evicting him, and to ruine his livelyhood as  Krishna Rao is paying rentals to other archaka Pintu.

said archaka Srinivas approached Dist. Legal Services authority, submitted a representation to order for eviction of shop and  mentioning  the Dist. Collector, Municipal Commision etc., as respondents. Dist.Legal Services Committee orally asking Krishna Rao to vacate the shop.  If it happens so, petty vendors family suffer starvation.

issue is pending with Dist Legal Services Authority, but the Endowments Department staff threatning the Petty Vendor of disposession and throwing out the goods in the shop.

How said petty vendor can get help by approaching court, can he file a suit for injunction against the endowment authorities and archaka srinivas to restrict their forcible activities. Petty Vendor needs immediate help for survivalÂ
