Registration

There is a circular no: 67 Dated 03.11.2011 (C.No.52338/C1/2011) Issued by The Inspector General of Registration, Chennai 600028.
This regarding "The large number of petitions being received in this department reveal that number of fraudulent registrations are increasing day by day. However, normal response of the department to such petitions is to direct the aggrieved parties to approach Civil Court. But, this reply to the petitioner is like committing double jeopardy against him"... Circular further states the filing FIR is one the statutory duties of the registering officer when such complaint is received.

Can you confirm whether circular is valid in Mumbai also.

Can any body suggest a solution without going to court( an expensive and time consuming procedure for a 68 year old)

Disputed property can ppe act 1971 be invoked without determining the actual ownership

Sir / Madam

Kindly give your expert opinion and citations.

The land is situated on the border of the Cantonment and Municipal and both parties are claiming ownership over the land, whereas the occupant has taken on lease from the Municipal the said plot of land, now the Cantonment has invoked the Public Premises (Eviction of Unauthorised Occupants) Act, 1971 (PPE ACT) and has issue notice to vacate the land.

Is there any judgement by the SC that if the property is in dispute the PPE Act cannot be invoked or that a civil suit lies if the property is disputed.

Another query is that whether a notice is required to file a suit as per section 80 CPC when the notice to vacate the property is given by the same authority.

Thanks in Advance

Issue of legal notice

Dear Sir,

Our Society in Mumbai has recd all permissions from BMC authorities for the redevelopment of our Society & the Developer has started the process of Registration of Individual Agreement with the office of Registrars. In the process 70% members have registered their flats & 20% members are under the process of registration leaving 10% members who have a dispute with the Developer regarding allotment of the new flats. The allotment of the new flats were done by a lottery system. Now the Developer has written a letter to the Society stating that he intends to serve legal notice on the aggrieved members.Till date the Developer has not given vacation notice (VcN)to the members who have registered their new flats stating that he will issue VcN after 100% members register their flats.

My query is,
1.whether the Developer is right in issuing legal notice without issuance of VcN.
2.Whether 70% of members registering their new flats holds good for issue of VcN.

Pl advice.

Venkat Iyer

Land problem

1) We are three brothers. We have three agriculture land . On this land ( On 7/ 12 utara) all three brothers name was available. In one of land is acquired by irrigation dept. Accordingly One brother is selling the sand from that land. hence my another brother has filed case on him (As a accused No.1)& on me (As a accused No.2).

2. In last year 30.10.2013 they have mutual agreed or settle and present the application to court regarding disclose the case and give the order(Hukumnama) accordingly what ever they settle. (In that application they have divided the land without my concerned as ex-party)(the application enclosed as Ex-57)

3. Accordingly court has mentioned that i) "the suit is disposed of as per the terms & conditions contained in Ex.57" & ii) "Costs in cause" ( document is enclosed)

my question is that whether as mentioned in sl.no. 3 it is order(Hukumnama) of court or it is closing of case?

Regards,
