Partnership firm having profit will be taken over by pvt ltd company having loss

Back Ground :

Family managed partnership firm and pvt ltd company having different business segments.

partnership firm paying income tax since it has positive income

where as pvt company having huge carry forward loss

Issues :

how to plan such a way that the loss in pvt ltd company may be utilized in partnership firm since it run by one family only

Society denying home loan noc

Hello,

I have purchased a flat in a building situated at goregaon east Mumbai. Flat is registered in my name 20 days back.
I am asking then Noc for Loan which they are denying to give due to below two reason:-
1) There managing committee term is over from last 1 yr 6 months. they are saying they do not have rights to give this Noc
2)As of now I am not the member of their society, asking me to wait till next AGM (Aug2017) for me to become member in society
they have taken 25000 rs also
My question is are any of this reasons are valid? and how do i counter them?

Hello,

sucession planning is very important. So my Father had given a lumpsum amount to my sister. My sister is married,

My Father has one house and some FD in bank. The FD has been t/f to my mother's name since she is the nominee. MY father is no more.

My father has a court registered will which says that after his death, both his movable and immovable property will go to his wife and his son only and no one else.

Now to prevent any future complications, my Mother wants the following. Pls comment whether below points are ok and pls add if something more needs to be done.

1) My Mother wants to make a will, that after her death, the house and other immovable assets will go to me and only me.

So what should be written in her will. Will her will also mention the will details of my Father ?

2) For Info,In the FD in her name, Iam the nominee

3) Do we need to do any other thing like giving some notice in a newspaper etc to prevent any future problems.

Pls note that my sister is not claiming anything nor any intention to do so. But to be on same side, My mother wants to be careful

Car on superdari

Hello,

My sister was living in with a guy three yrs back.My sister broke her FD and made payment by her cheque and online transfer to a car dealer but the guy took the temporary car number and then within next 2 days got the car registered under his name and ran away with the car.

Police case was filed under section 376,406 and 506. Only one FIR. we hired a lawyer. the hearing came up in gurgaon court in yr 2013 .In first hearing, we produced proof that payment was made by my sister. The court released the car on superdari (my aunt pledged her car in court for the same. ). the car is with us and we are taking insurance of the car
in the guy's name only so that we can drive it.

the guy was arrested in yr 2014 as he was on the run and was sent to tihar jail.The court hearing then came up for the same but with a different judge (other than the judge for superdari).

few dates were given and me, my sister and my parents were presented as witness.

then our lawyer told us that we do not have to come to court since not required and car we have to drive on superdari only for life.

It is been two yrs that we have not followed up with court and neither there is any correspondence from court. We did not find the lawyer very professional and so we did not follow with him too.

we are interested in getting the car in our sister's name so that we can sell it.

my questions.

1) how to get the case update. we do not want to call the same lawyer. Do we need to hire a lawyer again to see what has happened to case in last 2 yrs or i have seen many typist sitting in court and they can they help me in getting the case update or can i got to the court room window and ask for the case update (we only have FIR copy and superdai order but no file number)

2) will the car remain on superdari through life as said by our lawyer. Can't it be transferred in my sister's name ?. we just want to get car t/f to us. We do not want to follow the case since my Father died due to stress and neither my sister will go to court any more !

With regard to due date - clarification

Sir,

Receipt of showcause notice was on 26-09-2016 where in 7 days time(within 7 days) was granted. I submitted the reply to the showcause notice on 03-10-2016. But the assessing authority says the reply should have been submitted on 02-10-2016.Hence, kindly clarify as to what will be the correct due date ie.is it 02-10-2016 or 03-10-2016 in this case.
Normally, the day on which we receive the notice- will be it be counted or not to be counted.

Cyber law regarding domain name

Dear Sir
I bought a domain name in godaddy.com having a famous personality name. Now, a person contacted me that he wants to creat a website using the domain and has consent of the famous personality. Now he offers me that i should share the domain with him so that he can launch the site.
I bought it in investment purpose.
Please tell me what are the options for me:
1.sell
2. Share or
3. Rent.
Is shareing and donating the same?

Notice u/s 149 of crpc

My neighbour is constantly harassing me (scratching my car, throwing stones and spitting aimed at me or my kids). When I went to complain, the lady started shouting at me. At night I was called at local police chowki and came to know that they filed a false police complaint against me u/s 504 and 352 of IPC and police on the spot served me a notice u/s 149 of CrPC and told me not to indulge in any fights with them. Next day I left for Jordan for business trip. meanwhile I updated other residents of the society on common society whatsapp group about the incident and they expressed shock and concern. This further enraged my neghbour and when I returned home after trip I was again called by police and he told me that I have violated the notice served on me u/s 149 by informing other residents on whatapp and told me not to repeat. How come the police serve me a notice under 149 even without doing any investigation about the facts. Both sections 504 and 352 are non-cognizable. How can I deal with such intimidation tactics used by police in collusion with my neighbour? How should I challange this wrongful notice?

Arrest under ipc 151

Respected Sir,
i and my father were arrested under ipc 151 (crpc) because of a mere dispute with my neighbour.police arrested both parties under ipc 151.we were released on bail after compromise.this incident took place in 30 may 2009. that time i was 18.
sir can i eligible for government job.
plz help me..
