Execution petition

The exparte arbitral award was pronounced in Jan 2013 and execution petition was filed by the decree Holder(Mahindra and Mahindra financial services Ltd) in Feb 2016.what about the limitation period in this case? Is it time barred? I represent the side of judgement debtor.

I think the limitation period is three months from the date of receipt of the award.

Arbitration award can be challenged in 3 months.

Award can be executed as court decree.

You have posted another query qua debt of Mahendra & Mahendra Financial Services Ltd. for jurisdiction of DRT and now arbitration.

Discuss with a local lawyer if it is a real dispute, prima facie it is a hypothetical question.

You have lost the chance of filing a petition to set aside the arbitration award u/s 34 of the Arbitration and conciliation Act.

But, you can try in challenging the EP by filing a CRP or Writ. By this you can post pone the disposal of the EP.
