Fundamental Duties

(i) Why chapter IV-A, Article 51-A was inserted in the Constitution of India and what was the intention behind the amendment?

(ii) Whether any mechanism has been provided for enforcement of the provision or for monitoring its enforcement?

(iii) What efforts have been made (either by the Govt. or by any other entity) to ensure compliance of the provision?

(iii) Whether the provision has remained on the books only?

Credit Card Outstanding

I have outstanding of 30,000/- on a crdit card providing bank, i have been paying minimum amount due since last 1 year which does not decrease any amount but in every next months statements outstanding amount keep on increasing.
I requested bank to close my Credit Card and make my outstaning in EMI or convert my outstaning in loan with interest as per their rule. But they did not done and refused proposal to my e-mail request. Now bank keep calling me and abusing me on phone. What could be remedy for this. As i want to pay all outstanding but its not possible to pay at a time.
Should i suggest them to file case against me ?
What will be advice/punisments/remedies for me from court on what sections they can file me a suit?
will it be criminal/civil or both ?

Vehical Manufacturer's Liability

I booked TATA207DiEX vehicle with Tata Motors Dealer in Goa.
He handed over me a vehical and issued sale letter (Tax Invoice) for TATA207DI EX vehicle.He also gave me a booklet"Owners Manual and Service Book for TATA 207 EX/RX"
There are two models EX and RX.
RX is cheaper by Rs. 14000 or so.
When I checked the specifications from the Manual with my model I found most of the specifications match with RX rather than EX. Also few facilities mentioned in the Owners manual like ventilation Blower, Tilting Steering box etc are missing.
I asked the dealer. He says "It is EX" I sent a mail to customer care of Tata Motors. No reply. Their Toll free 24 hr. No. 1800 22 5370 only rings.Their web page for Tata 207DI does not function.
Wrote a letter to the dealer. After 15 days received a call from Tata motor's service engineer advising me to read two lines on the opening page of the manual"The contents of this book are not binding on us. We reserve the right to change the specification without notice"
WOW. I asked him with this line if you hand over me a bullock cart should I accept. He said yes.
What is the remedy for me. I feel cheated. I feel more pain the such things are not expected from Tats.

withdrawal of case filed u/s. 498A

A has filed a case before the court, and it is now at the stage of EBC. now due to compramise A wants to withdraw the case. Whether A can withdraw this case by giving a withdrawal pursis? if not then what is the procedure to withdraw this case. please answer urgently.

long term capital gain

the applicant sold flat on april 2008 for rs 12 lac which was purchased on 2000.01 for rs 5.25 lac now applicant want to invest the amount in new flat and installment starts from april 2009 the amount of flat is 27 lac.will the applicant get deduction or not

My father got property share under arbitration award between three of the brothers including my father, but after the award got registered and became a decree and my father's brother challenged on some false grounds claiming large amount of money from us and finally in order to settle the dispute we admit to give the amount of Rs549000 on sale of our property in which we are living and he is also living with us in a room occupied by him.Now when we are ready to sell our house he is demanding 8 lacs more to vacate the property. The time limit for sale of house expired in Nov.2009 and we filed a petition for extension for 6 more months and today judge has dismissed the petition and did not grant any time extension.Now my father brother threatening for filing contempt against my father for not selling the house or may be he file for execution through court.My lawyer suggesting for filing execution appeal by us.Pls suggest will the court have power to aution the property even when we are ready to pay him 549000.The deed is given below::

This Compromise Deed is executed on 18-02-2009 at Ludhiana amongst Sh.Kuljit Singh-Petitioner and the respondent No. 1 & 3.
Whereas the aforesaid objection petition is pending against the Arbitration Award dated 11-12-2007 registered on 14-12-2007 with the Sub-registrar, Ludhiana in this Hon’ble Court.The parties have arrived at Compromise and terms & conditions of the same are as under, which is part & parcel and suplementary to the said Award.
1. That the H.No. B-I-815, Ludhiana will be sold in the open market by Sh. Sarvjit Singh within 6 months from the date of getting a T.S..-1 from M.C. Ludhiana. The original time period of 6 months for selling the house will be extended for reasonable time, if any legal complication arises.
2. That none of the parties and their family members of the Arbitration Award shall have no right to purchase the said house in any manner directly or indirectly.
3. That till the sale of the said house, Sh.Kuljit Singh –petitioner has a right to stay and enjoy the said house in a husbandry manner.
4. That after paying Rs.5,49,000/-(Rupees Five Lac Forty Nine Thousand only) to Sh.Kuljit Singh-petitioner by Sh. Sarvjit Singh-respondentNo.1, rest of the consideration amount will belong to Sh. Sarvjit Singh absolutely.
5. That the said amount of Rs.5,49,000/-(Rupees Five Lac Forty Nine Thousand only) shall be paid by Sh.Sarvjit Singh-respondent No.1 to Sh.Kuljit Singh-petitioner at the time of the sale of the house out of the sale proceeds.
6. That on receipt of Rs.5,49,000/-(Rupees Five Lac Forty Nine Thousand only) ,all the claims of Sh.Kuljit Singh-petitioner in respect of the estate of deceased Sh.Gurcharan Singh,father of the objector/petitioner,shall be fully settled and nothing shall be remained due towards Sh.Sarvjit Singh and his family and Smt.Surinder Kaur- respondent No.3.
7. That the above said terms and conditions are part & parcel and suplement to the said Arbitration Award and the same is enforceable and executable along with the above said terms.
8. That each party will give his affidavit regarding no objection for the change of ownership as per the Arbitration Award.

GPA rights

Can the gpa holder sell or lease the land without including the owner in the deal?
i have given power of authority of my land to my uncle with this condition that he can use it as he likes. i have given him exclusive rights to do what he wants with that land and also that i don't want to be part of any deal he makes or the money he gets from the land. i just want him to have that land all by himself doing what it seems fit for him. my question is if in the future he wants to sell or lease the land to someone, is my presence or signature needed in the deal of selling or leasing?
