Succession

One Mr. X inherited the land to an extnet of 8893 sq.yds. from his father. The father of Mr. X died intestate and as on the death of father of "X", he is bachelor.

In the year 1984 "X" executed GPA document in favour of "Y" for 17,787 sq.yds. The remaining land which is got exeucted by "Y" is the land of sister of GPA holder.

While in the force of GPA document the GPA holder executed only one registered sale deed and 5 notarised doucments.

Mr. "X" came to know about the acts of GPA holder cancelled the GPA document in the year 1991 vide doct.No. 10/1991.

With wrong impression again the GPA holder created the GPA document vide doct.No. 11/1991 on the same day.

While in the force of GPA document the GPA holder executed 15 registered documents.

Again in the year 2003 Mr. "X" came to know the acts of the GPA holder and cancelled the GPA document. After cancellation of GPA document GPA holder executed another 15 documents.

For which Mr. "X" filed cheating case against GPA holder.

While things stood Mr. "X" died in the year 2009.

Now the point for consideration is whether Mr."X" is competent to execute GPA for entire land.

Or the children of "X" also share holders to the entire property which is inherited by the "X". Since the property is ancestral. As on the date of inheritence "X" is bachelor.

As on the date of execution of GPA document in the year 1984 "X" is having one daughter.

Now "X" is having three daughters and two sons.

Under which provision of law the children of "X" succeed their land.

OR the children of "X" is entitled for the land which executed by the GPA holder after cancellation of GPA document.

Plz. suggest clearly.

Regarding rental property

I have given my property for rent to a tenant for the past 20 years. He was doing some business in that space. During the last one year period he has not paid the rent. I was asking him to vacate the property since he was not paying the rent, but he did not do that till now. Suddenly yesterday my tenant was vacating the property and was planning to rent it to another person, I also got the news that he had taken the advance for renting the property. When I called my tenant he was not ready to talk properly. When I asked him what to vacate the property and give the keys, he talked very badly. What should I do in this case?

Competition commission of India

Dear sir,
I have question regarding Competition commission of India.
My question is that: "Does Indian parliament have the power to enact any law restricting or banning or taking any action against a company on the ground that companies have violated any anti-competition norm?"
"Parliament can only pass this act after competition commission enquires the matter?"
"Is it necessary that anti-competition cases will only be looked after by this commission in the initial stage or parliament can also take descisions in certain cases
by enacting any act for two companies indulging into anti-competitive acts?"

I'm eagerly waiting for ur reply.

Inheritance of husband's property

Dear Experts,
My husband died in an accident last year. He bought a flat in 2007 whose registration was not done. He took a loan . Now the bank wants to waive off the loan after verification of all documents and it has wanted signatures of legal heirs. I learnt that my mother-in-law is also a legal heir ( along with me & my 2 minor daughters) and she has 1/4th share in the flat and in her absence that 1/4 part will be divided into 6 parts ( me, 2 daughters & my 3 sisters-in-law) . My mother-in-law & my sisters-in law have tortured me mentally since the last 10 years & after my husband's death staying with them has become unbearable. THey are constantly accusing me of my husband's death in front of my children. I cannot live in the new flat as it is in an upcoming locality with much transport difficulties.I have looked after the maintenence of the flat & paying fees since the last 1 year. My father-in-law owns a flat and in his absence it will pass on to my mother-in-law and he also draws a pension. I had requested my mother-in-law to write her share in my husband's new flat in our daughter's name and in return I agreed to pay her either 1/4 amount of value of flat or in return of my share in my father-inlaw's flat. She has refused to do so at the insistence of my sisters-in-law.
I would be grateful if the following questions are answered:
1. Does the law bring justice by giving away part of my husband's hard-earned money to his well-off and married sisters and who have always misbehaved with us?
2. Is there any legal way in which I can get the flat in my & my daughter's name ? My sisters-in-law will trouble me so that I cannt sell it in future if need arises. I am not working & 2 of my sisters-in-law who are in India are working and the 3rd one is in USA for the last 10years.

Regards,
