Dear friends
I request you to please clarify the following:
A) A private limited company issued a cheque for Rs.10 lakhs. When the cheque was presented for clearing, Bank has returned the cheque with 'return memo'.
B) REASON FOR RETURN
Code No.
(01-09) FUNDS
01 Funds insufficient
02 Exceeds Arrangement
03 Effects not cleared:Present again
04 Refer to Drwaer
Note: Bank has marked no.03 for the reason for the return of cheque in the cheque return memo.
C) It is the outstation cheque and the validity period of the cheque was about to end, we could not represent the cheque and proceeded according to NI Act
D) We confirmed that, there is no amount in the bank account as on that date and so many other cheques were also bounced during that period of one month.
E) Now the accused is trying to defend that, since the cheque 'was requested to represent' it will not come under the provisions of NI Act
Can u please advice in the above matter. Please post me the judgements, if any are available in this regard.
Now this case is in hearing

Will a commercial business agreement sighned on a stamp paper between Landlord & tenant has leagl value,even though its not Registered.
Can the document be registered by the tenant only.
If not registered,is it possible to register the document, at the time of any dispute between landlord & tenant in court.

Dear all,
In a sale agreement if any condition contained that the buyer shall be responsible for complying with all the registration formalities and payment of stamp duties etc and have to pay the balance amount (difference between earnest money and total sale price) within three months and if the buyer fails to perform and to pay the balance then the agreement shall be cancelled, would it be a valid clause? And if it is contained in the said agreement that so long all the formalities as aforesaid is completed the sale should not be an absolute one would it also be valid term. If the buyer fails then would it act under doctrine of part performance Under section 53A of the Transfer of Property Act? And in such circumstance should the the buyer or the seller who shall have the optimum right over the property?

i just wanted to know in the Domestic Violence Act 2005 can a female who is not related to the applicant nor any of the other respondents by relation nor shaing the household can be made party in Domestic Violence proccedings as a one of the respondent.

Dear sir,
We are traders of scrapped tyres in mysore, karnataka. In Karnataka state the delivery note is to be generated by means of website.
our firm has a sister concern in bangalore, Karnataka. Since the person who looks after the office in mysore is not at all equipped with the computer knowledge, the details of delivery note will be uploaded in bangalore, printed in bangalore and the delivery note shall faxed to the person in Mysore. All the three copies ie original, duplicate and triplicate shall be faxed. Then the concerned person in Mysore will take the xerox of the faxed copies sign on the same and will be sent along with goods.
But we are fined Rs 60,000/- by the sales tax authorities stating that xerox copies of the faxed document are not original documents.
But my question is since the delivery notes are web generated, does it make a difference whether it may be first print or xerox copy of the faxed document. However i would agree that if the delivery notes were issued by the sales tax dept in physical form, as done before, then taking xerox copies of the same would have no validity. But how can it be the case with web generated forms, where the document is always present in the database.
I have decided to appeal against the order, so is there any statute defining the meanings of original documents.

i am working at VVP engineering college rajkot gujrat. i was selected as assistant professor in sept 2003. as per condition of appointment order i have to complete phd in seven years otherwise my appointment will be autometically cancelled [as on 5/9/10]. institute alllowed me to do phd in normal university vacation only at ms university baroda and against that i had sign bond of five years and one lakh rs. i am not able to complete phd. our chairman has threatan me many times that they will terminate me if i do not complete phd as per appointment order. under this circumtances i found new job now.
as soon as they heard that i found new job they are showing my bond and may force me to stay five years after phd completed. i can not complete phd. i want to go out of this mental torture . what should i do? i have already given three month notice to institute.
i have signed bond on 5/10/05 . which has completed five years
