NEW PENSION SCHEME 2004

Sir,
Govt. of India start NPS by notification dated 22.12.2003 which is executive order by nature.

Also there is not legislative sanction for this order.

Money is deducted from the salary of central govt employee for pension.

Also pension act 1871 is not ammended for the purpose.

Is it unconstitutional to introduce NPS by this way ?

Succession certificate

I have been told that succession application should accompany an affidavit and undertaking. I have not been able to get hold of their formats. Shall be grateful if some expert makes them available.

Exchange deed

Hello,
I bought a piece of land from a developer few years ago. I now came to know that this land is in dispute and some one else is claiming ownership. The person who sold it to me says he will give me another land of similar value through an exchange deed (he gets the disputed land and I get another land) and he will fight out the dispute. Is this a safe way to proceed. Also is it possible for me to give a POA to my family member to execute the deed on my behalf.
