Mortgage deed

I have approached an advocate for Legal opinion as per requirement of a Bank Loan.He suggested me to obtain certified copies of some Link documents.All are in good condition except one.The document said to be "mortgage deed" is not legible as the scan quality is poor.Original or Photo copy of that document is not available with me.Advocate says Legal Opinion is not possible without that particular document.Is it true?How can I get the mortgage deed copy(transaction occurred before 20 years in another bank)? However I have provided "deed of conveyance" given by the bank(after closing of the loan) relating to the particular mortgage transaction.Is not it sufficient to give legal opinion ?Please guide me.

Notice in consumer complaint

Sir/madam, My brother in law died due to negligency of the doctor of a govt. hospital. I m going to file a complaint against this medical negligency in the national commission of consumer forum. My ques. are that- 1. Is it mandatory to issue notice to all of them before filing a complaint and if it is not mandatory, even then should i serve notice to all the opposite parties before filing complaint. 2. How much days notice is mandatory to serve? Would a 15 days' notice would be sufficient amd as per law. 3. How much cud be the amount of claim as my brother in law was in govt. service and his salary was Rs. 90,000/-per month and the govt. is now providing monthly pension to the family that is around half of his salary i.e. Rs. 42000/-. 4. Has the new consumer protection act, 2019 been applied or the case will be filed under the proviaions of old consumer protection act 1986.

Period of limitation

"A" is a Manufacturer has supplied material to his customer on credit basis and lastly supplied the material on 12/06/2015. The said customer has paid an amount of Rs.56,000/- lastly on 05.09.2016 and finally he is owning a debt balance amount of Rs.4,23,100/-. No notice was served as of this day by the Manufacturer to its customer for filing of the suit. Now the Manufacturer wants to file a suit against its customer. If so, the claim of Manufacturer is within the limitation or not?. Plz. suggust me suitably.

CIDCO DOCUMENTS

We are buying cidco flat from seller..but there is issue that they have only possession letter issued by Cidco but allotment letter is missing so there is any issue in future if allotment letter is missing

Rights to sell gifted property.

Hello Experts,
I have query regarding one of my property. We are three brothers and my mom have acquired some 150 sq.yds of property through my maternal grand mother by way of a WILL. Later in 2006 the same property my mother transferred the property to us three brothers by way of a registered gift settlement deed, however it is no where mentioned in the Deed that all of us have equal share its only a simple Gift. Now I and my younger brother wants to sell the property as we stay in that house and as we live in our respective portions (my elder brother live on the first floor and me & my younger live in the ground floor) but our wives always quarrel with each other on a daily basis so unable to bear this I and my younger brother have decided to sell our share and buy some new house in different places, but my elder brother is not allowing us to sell the property though we have also asked to purchase the property if he is interested, however earlier my elder brother tried to sell his share to some third party and when i objected to it as I was interested to buy the same. Now our problem is we cannot live like that our wives fighting with each other on daily basis. I want a final solution for this. my queries are:
1. Can I file a case in the court so that the court can order my brother not to interfere in our property and we can
sell it easily without any problems?
2. Can we sell our share of property? can my brother file a case against us?
3. Is there any other remedy? But most probably i want a court order?
Plz suggest me.

Absolute owner

Sir,
I had entered an Property agreement since the Party has given advertisement that he is absolute owner of Independent house at layout.
After the agreement I came to know that the house is under mortgage at bank. Water and sanitary connection/ maintenance is under control of Layout developer and no document.Developer has not handed over to urban authority. But building tax has recovered. Now the case is filed as Original suit for recovery of Advanced paid amount and penalty.
During evidence statement the vendor agrees that he is not Absolute owner.
But my advocate says once Sale deed is over by Developer to first party he is Absolute owner.
WHICH IS CORRECT

Car parking allotment

Hi Experts,
My cousin entered into a JD with a developer, the project completion was delayed by many months (though possession given with pending issues). Finally builder marked parking. He had a meeting with my cousin about allotment which was not reduced in writing, and next he allotted parking to his customers without any written agreement on parking with my cousin (who is the landlord). The parking allotted to my cousin is less than the agreed percentage in his JD (he was offered 35% but the actual parking he is left with now is less than that, he got 1.5 parking slot less and also got more smaller slots). The buyers are now in the process of making an association in 2-3 weeks. The landlord is completely sidelined in the allotment process.
What options are there for the landlord to prevent further damage? If an association is indeed formed, should he also become a member? Also how to rectify the allotment errors?
Please suggest soon. (this is in Bangalore).
