Order 21 rule 48(3)

what are the steps to be taken under order 21 rule 48(3).
garnishee did not attache the salary of JDR and EP is made absolute. even the garnishee did not attach the salary of JDR. show cause notice sent even though the garnishee did not attach. court ordered steps to be taken under order 21 rule 48(3). what are the steps in those aspect. please suggest.

Regarding filing of ep

Sir, in money recovery suit, the plaintiff/ Petitioner get interim attachment orders on defendant properties. while the court ammen attaching such properties, a third party voluntarily stood as surity and he handed over his property original documents to the court ammen. The court ammen prepared and submitted his report accordingly. after that in such suit the defendant set exparty and passed the orders. the defendant alienated his properties to others. How i approach the court through EP for recovery of suit decree amount. the court did not pass any order in such I.A. based on court ammen report. kindly suggest me.

Cancellation of mutual consent divorce decree

parties obtained the decree by mutual consent for divorce. after that wife father died and she has no source to live individual. she get compromised with her husband and now they get cancel the decree of mutual consent divorce. how will i move the petition before the court?

Salary attachment of jdr

jdr is a government teacher, and his garnishee received the warrant in 2017. E.P. is allowed in 2019. when i filed the sent for petition in 2021, garnishee sent his reply to the court that the jdr is transferred to another school in the year 2022. through the court, new garnishee also received the salary attachment warrant in this january-2023 but he did not respond in anymanner. what are the steps to take. please suggest me. thank you to all.

On ni act case

accused gave me a cheque which is dishonored and i sent a registered notice to him on 23.08.2019 and immediately on 24.08.2019 he replied through his counsel by denying the facts of the notice. i filed a complaint under section 138 of Ni act on 08.09.2019 and the same is returned for pre limitation i.e. not gave a time of 15 days for accused for the payment of cheque. my question is it is not valid for pre limitation or not but he replied to my notice by denying the notice facts. what is the solution for this how i move on court. please respond. thanks to all advocates.

We want to cancel "Agreement of Sale Cum GPA" original copy. Can anyone let us know, how to cancel the "Agreement of Sale CUM GPA" without original copy. Both the parties are ready (mutual understanding).

On ni act case

Respected Advocates,
i filed a case on NI act provisions. in this matter the court issued nbw against accused. i made all efforts regarding to find and arrest the accused. but not succeed. even the accused father reported to advocate commissioner he did not know about the accused. his ancestral properties are also transferred. what should i do??
one more thing he is very active in social media such as facebook and other. can i file a petition by praying the court to make an order for finding the accused through cyber police based on his facebook account??? please advise me? in what way i suggest my client please advise me.. thank you all

Regarding will executed by widow for unpartitioned property

Respectable Sirs,
husband died intestate by leaving his wife, 2 sons and 4 daughters. all are get married during his life time and before 1980. the self acquired property of the deceased are enjoyed by the wife and 2 sons. now the widow of deceased, want to make a will regarding her share on the unpartitioned property. is this will become valid after her death or not. please advise me. thanks to all

Possession of land based on POA

My aunt has given POA to my uncle, in which she has given all rights with respect to the land which is in her name. And it is a registered POA.
NOW, my aunt is bedridden. And my uncle wants to sell off the land. Land is near chennai ,and my aunt and uncle are living in madurai. She cannot move .
When we approached the registration dept for enquiry. They are asking my uncle to get registered with' self declaration 'form for the full possession of the above said property first, and then apply for patta. Is that procedure is right?. If so., Pls send me the format for self declaration form for possession of the property through POA. Kindly do the needful.

Reg ex partee divorce( wife address unknow)

I have got married 15 years ago. For the last 9 years we are living separately. I haven't visited her for the last 7 years. So i dont know her current address.I applied for divorce in the year of 2017. where we were living last(Chennai)
Since my wife address is unknown the court address has ordered for paper publication. Mean while i came to know that she is living Bangalore and but complete address is unknown.

My question is .
Do i need to ask my lawyer to give paper publication in Chennai and Bangalore news paper?. Will the court accept or allow us to give paper publication in Bangalore, if we say that she is living currently in Bangalore? ..

Please advice me sir. My Lawyer says we will give paper publication in Chennai alone and not in Bangalore.
