Computation of Salary : 26 / 31 Days...?

Dear Experts,

I have doubt. Till now in my experience we are considering 30 / 31 / 28 days as the basis for salary computation. Where as the actual wage should be 26 days only. even we calculate gratuity for 26 base only.

then my doubt is that while calculating..the lop and net salary which method should be followed and any rule / act to refer as under:

1. Earned Salary = Actual Gross / No. of total days in a month * Actual working days.

or
2. Earned Salary = Actual Gross / 26 * Actual Working Days.


which is the correct Method ? I have been asked by the management that when we are paying for 26 days (gratuity), why cannot we calculate for 26 days for payroll also instead of 30 / 31 days ...?

URGENT: Retirement Age & Medical Unfit - Compulsory Retirement - Voluntary Retirement

Dear Expert,

I have doubt. We are into a Pvt Transport company. there are some employees who does not have even offer / appointment letter.

There are a few persons who crossed 58years. is there any law/provision that we can make them retire/ voluntarily make them retire ?
as its a transport co, can we by force ask some employees who are medically unfit for that job /

please reply .urgent.

Can an employer directly employ contract labour or it needs to employ them thru a contractor.

Non payment of retainership for consultancy work

Can a factory refuse to pay retainership to a consultant because he did not submit a resignation letter one month in advance and left by submitting a resignation just 4 days before he left after working for one full month? Please let me have your expert opinion?

How to handle a worker's notice who left the organsiation ?

I sent a worker who was not co-operating with other workers and amount is also settled in March 2008. He was working in my company for more nearly 4 years and in the middle of the above tenure his service was terminated twice. Now after 4 months he sent a registered letter(Not a lawyer Notice) that removal him from the service illegal and all the settlement benefits have not been given and hence to reistate him. My company is a small printing company and only 5 workers are working and no formal appointment letters are not given. Even ESI is also not covered due to the low number of employees. The said workers was mischievious and who was interacting with another worker who also left started similar business in our area. He joined with her now after the removal and giving maximum mental torrtures to me by way of anonimous letters, sms and phone calls.
Now kindly advise me what are all the legal rights he possesses to claim any amount from me. What are all the precautions i have to take to prevent further complication in this matter.

Working Hours

Hello Friends,

Govt of Gujarat has apssed a notification whereby due to power shortage, various industries have been asked to operate for 5 days.

In such a situation, can the employer compensate the additional weekly off by adding the same no of hours to other week days.

Whether such a move will require approval from the labour inspector ?

Whether overtime needs to be paid ?

Urgent Query about Providend Fund

Hi All,

My mother in law is a working woman & now she is going to resign from her job. My query is..........

Management of her company says that she may resign but she will apply for withdrawl of PF only after two months after her resignation. I want to know that is there any specific time limit to apply for PF withdrawl? If so then pls send me circular any other documents related to this.
