sir,
I am a bank officer.And suspended from bank service with effect from 14 august2009 till now..and remained in jail for fifteen days in a criminal case not related with the bank job.Till now no chargesheet,no review of susupension till feb2011.plz let me know whether my suspension is justifiable or not. what should i do.Departmental appeal was turn down on feb2011.plz suggest me for further action.

legal approach for reliving letter and settlement

hi

i have resigned my job with 18 days notice + submitted earned leave 15 (total 33 days).
As per my appointment order my notice period is 1 month.

i dont believe the company.what should i do if i dont get the relieving letter and settlement.

what is the procedure if i should go legally.

Bonus period

Sir,

I have been receiving Bonus right from confirmation of service ( 01.12.2006) with the current employer.Though I am getting the Bonus in November of every year, I have my own doubts as to whether for Bonus, January to December of an year or 1st April to 31st March is the relevant year for calculation of Bonus period. I have received Bonus from my employer up to 2010.
I need clarification on it, as if a person resigns in July 2011, will he get Bonus for four months from April 2011 to July 2011 ( 2011-2012), as the Company has made sufficient provision for it in the Accounts.

Leave Encashment

Dear Sir,

Thanks for the prompt reply to my earlier queries. I will be thankful, if the following query is resolved.

Suppose if Basic pay is 4800/- per month and HRA is Rs 2200/- per month and conveyance is 500/- per month and the rule of leave encashment in which the employee is working is such that an employee can encash up to 20 days leave in a previous year, then what will be the amount an employee gets on resignation, say after service notice period of one month, the leave available to his credit is 56 days.as on 31.12.2010.

If the employee resigns in July or August 2011, is it possible to add the Earned Leave available during the year (30 days) with the 56 days already available to the credit. If so, leave encashment is for 86 days (56 + 30). Am I correct?.

Non Payment of Eligible Gratuity Amount

I have completed Six year and five month of my regular service with an organization. But my employer is not doing payment of my gratuity amount, even he is not giving answer of my mails and letter which I sent to him through ragistered post regarding payment of my gratuity amount.

Kindly suggest how can I get my gratuity amount from my employer on a Legal Graound.

i am an ex-servicemen and presently serving in self finance college in gujrat
college pays salary and allowence as per the govt rule and regulation recently college under process of paying 6th pay commission is their any rule to get me pay protecton under govt rule

JOB PROPOSAL CHANGE

DEAR SIR,

MY FRIEND FIRST GOT A JOB IN BANGALORE AND GOT THE OFFER LETTER. BUT TILL NOW HE HAS NOT JOINED. STILL HE TRIED TO FIND JOB IN ABROAD. NOW HE GOT THE JOB IN ABROAD. THE SALARY PACKAGE IS BETTER THAN THE LOCAL JOB. SINCE HE HAS NOT JOINED TIL NOW FOR THE LOCAL JOB, HE DOESN'T KNOW HOW TO DECLARE TO THE LOCAL COMPANY. HE WOULD LIKE TO KNOW WHETHER THE LOCAL COMPANY WILL ACCEPT IF HE DOES NOT JOIN OR WILL THEY MAKE ANY ISSUES ON IT. PLEASE ADVISE SIR.

Form 16 not supplied by employer

G worked as Sales Manager in private Life Insurance Company and was harassed by bosses, and forced to resign.She tried her level best, and resisted. She was terminated.She approached her lawyer and filed complaint with labor authorities.
Her case is referred to labor court.
She wanted to submit her reimbursement claim, and was not supplied the forms, despite reminders, in writing.
What should be done by her.She can include her claims in present case or has to file another complaint separately.
She was not supplied her form 16, despite reminders in writing.Based on her own calculations she has filed her ITR.
She wants to lodge a complaint with I.tax authorities.
Where can she file the complaint? At her location or at the location of HO of the company.
Kindly help.

SALARY ISSUE

hai friends./seniors. i required your valuable advise. i am working as a HR Manager in a company from past 4 years. by character i am self respecting individual and very straight forward by nature. i do not have a bad name in the company and all are likes me. but due to managements some unprofessional plans i have got some 3 HODs from past 4 years and all are not from HR background.but due to my stick to the company and dept i have not allowed to happen any disturbance in the dept. now i have got a dept HOD and he is wont likes me and has plays too much politics.but he never shows me his dislikes. but due to my patience level and respect to dept, i have continued to stay in the company. now from past 5 months i have not got my salary and my HOD plays game in b/w my salary release. he is heading our region and finance.as our company has some financial problems, initially i have thought as HR i should not ask for salary and most of the employees get after a month delay. because of my salary even happend some rift b/w some HODs and my HOD.now after few days i have started asking salary , still it is not happened. but due to my bad financial condition i m not able to resign and go.now i am realizing my 4 years stay here is a foolish decision i a have taken and your advise to overcome the situation is more valuable.
